GRAF -- read once and referred to the Committee on Social Services AN ACT to amend the social services law, in relation to requiring resi- dency for the receipt of social services THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Paragraph (g) of subdivision 1 of section 158 of the social 2 services law, as added by section 44 of part B of chapter 436 of the 3 laws of 1997, is amended and a new paragraph (h) is added to read as 4 follows: 5 (g) is a qualified alien who is ineligible to receive assistance fund- 6 ed under the temporary assistance for needy families block grant solely 7 because of section four hundred three of the federal personal responsi- 8 bility and work opportunity reconciliation act of 1996 (P.L. 104-193) 9 or is an alien who is permanently residing under color of law but is not 10 a qualified alien[.], OR 11 (H) IS A RESIDENT OF NEW YORK STATE AS SUCH TERM IS DEFINED IN ARTICLE 12 FOUR OF THIS CHAPTER. 13 S 2. The social services law is amended by adding a new section 21-b 14 to read as follows: 15 S 21-B. RESIDENCY REQUIREMENT. THE OFFICE OF TEMPORARY AND DISABILITY 16 ASSISTANCE SHALL REQUIRE THAT THE RECIPIENT OF ANY BENEFIT UNDER THIS 17 CHAPTER SHALL BE A RESIDENT OF NEW YORK STATE AS SUCH TERM IS DEFINED IN 18 ARTICLE FOUR OF THIS CHAPTER. NOTHING IN THIS SECTION SHALL BE CONSTRUED 19 IN ANY WAY TO LIMIT THE POWER OF THE OFFICE OF TEMPORARY AND DISABILITY 20 ASSISTANCE TO PROMULGATE THE REQUIREMENTS FOR BENEFITS RECEIVED UNDER 21 THIS CHAPTER AS SUCH POWER IS GRANTED BY SECTION ONE HUNDRED TWENTY-TWO 22 OF PART B OF CHAPTER FOUR HUNDRED THIRTY-SIX OF THE LAWS OF NINETEEN 23 HUNDRED NINETY-SEVEN. 24 S 3.
