Bill Title: Provides that non-profit organizations, certain governmental entities and certain Indian tribes which are liable for unemployment insurance payments in lieu of contributions shall only be liable for fifty percent of payments for benefits to claimants that were a result of the closure of such employer or a reduction in the workforce of the employer for reasons related to COVID-19.

        AN ACT to amend the labor law, in relation to providing that  non-profit
          organization,  certain governmental entities and certain Indian tribes
          which are liable  for  unemployment  insurance  payments  in  lieu  of
          contributions  shall  only be liable for fifty percent of payments for
          benefits to claimants that were  a  result  of  the  closure  of  such
          employer  or  a reduction in the workforce of the employer for reasons
          related to COVID-19

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Section  563  of the labor law is amended by adding a new
     2  subdivision 8 to read as follows:
     3    8. Notwithstanding the provisions of this section to the  contrary,  a
     4  non-profit organization which is liable for payments in lieu of contrib-
     5  utions  shall  only be liable for fifty percent of payments for benefits
     6  to claimants that were a result of the closure of  such  employer  or  a
     7  reduction  in the workforce of the employer for reasons related to novel
     8  coronavirus, COVID-19, or due to a mandatory order of a government enti-
     9  ty duly authorized to issue such order to close  such  employer,  on  or
    10  after March twelfth, two thousand twenty.
    11    §  2. Section 565 of the labor law is amended by adding a new subdivi-
    12  sion 10 to read as follows:
    13    10. COVID-19 closure or reduction.  Notwithstanding the provisions  of
    14  this  section to the contrary, a governmental entity which is liable for
    15  payments in lieu of contributions shall only be liable for fifty percent
    16  of payments for benefits to claimants that were a result of the  closure
    17  of  such  employer  or  a reduction in the workforce of the employer for
    18  reasons related to novel coronavirus, COVID-19, or due  to  a  mandatory

     1  order  of  a  government  entity  duly authorized to issue such order to
     2  close such employer, on or after March twelfth, two thousand twenty.
     3    §  3. Section 566 of the labor law is amended by adding a new subdivi-
     4  sion 12 to read as follows:
     5    12. COVID-19 closure or reduction.  Notwithstanding the provisions  of
     6  this  section  to  the  contrary,  an  Indian  tribe which is liable for
     7  payments in lieu of contributions shall only be liable for fifty percent
     8  of payments for benefits to claimants that were a result of the  closure
     9  of  such  employer  or  a reduction in the workforce of the employer for
    10  reasons related to novel coronavirus, COVID-19, or due  to  a  mandatory
    11  order  of  a  government  entity  duly authorized to issue such order to
    12  close such employer, on or after March twelfth, two thousand twenty.
    13    § 4. This act shall take effect immediately.
