SYNOPSIS

     Removes certain Master HVACR licensing requirements for licensed electrical contractors for 12 months.

An Act concerning heating, ventilating, air conditioning, and refrigeration contractors, and supplementing P.L.2007, c.211 (C.45:16A-1 et seq.).

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  Notwithstanding any other provision of P.L.2007, c.211 (C.45:16A-1 et seq.) to the contrary, the board shall, upon application to it and submission of satisfactory proof and the payment of the prescribed fee within 12 months following the effective date of P.L.    , c.   (C.   ) (pending before the Legislature as this bill), issue a Master HVACR license to any electrical contractor licensed by the Board of Examiners of Electrical Contractors, pursuant to P.L.1962, c.162 (C.45:5A-1 et seq.), who has been engaged as an electrical contractor for at least two years prior to the date of application for a Master HVACR license.  To be eligible to obtain the Master HVACR license, a licensed electrical contractor need not meet the qualifications set forth in section 13 of P.L.2007, c.211 (C.45:16A-13) with respect to education, experience, or examination.  A licensed electrical contractor who is issued a Master HVACR license pursuant to this section shall meet the other requirements of P.L.2007, c.211 (C.45:16A-1 et seq.) necessary to maintain the Master HVACR license.

     b.    The State Board of Examiners of Heating, Ventilating, Air Conditioning and Refrigeration Contractors, in cooperation with the Board of Examiners of Electrical Contractors and the Division of Consumer Affairs in the Department of Law and Public Safety, shall send notification to every electrical contractor licensed by the Board of Examiners of Electrical Contractors, and make information available to the public, regarding the provisions of subsection a. of this section.

 

     2.    This act shall take effect on the first day of the second month next following enactment, except the State Board of Examiners of Heating, Ventilating, Air Conditioning and Refrigeration Contractors and the Director of the Division of Consumer Affairs shall take any anticipatory administrative action in advance as shall be necessary for the implementation of this act.

 

 

STATEMENT

 

     This bill requires the State Board of Examiners of Heating, Ventilating, Air Conditioning and Refrigeration Contractors, for the 12 months following the effective date of the bill, to issue a Master HVACR license to any licensed electrical contractor who been engaged as an electrical contractor for at least two years prior to the date of application for a Master HVACR license.  A licensed electrical contractor who is issued a Master HVACR license under the provisions of this bill need not meet the qualifications for Master HVACR licensure with respect to education, experience, or examination as required pursuant to section 13 of P.L.2007, c.211 (C.45:16A-13).  The bill provides that a licensed electrical contractor who is issued a Master HVACR license pursuant to the provisions of the bill must meet the other requirements of P.L.2007, c.211 (C.45:16A-1 et seq.) necessary to maintain the Master HVACR license.

     Under the bill, the State Board of Examiners of Heating, Ventilating, Air Conditioning and Refrigeration Contractors, in cooperation with the Board of Examiners of Electrical Contractors and the Division of Consumer Affairs in the Department of Law and Public Safety, will make information available to the public, and send notification to every electrical contractor licensed by the Board of Examiners of Electrical Contractors, regarding the provisions of the bill.
