     Permits counties and municipalities to withdraw from civil service system and maintain veterans preference.

An Act permitting counties and municipalities to rescind the adoption of civil service and maintain veterans preference and supplementing Title 11A of the New Jersey Statutes.

 

     Be It Enacted by the Senate and General Assembly of the State of New Jersey:

 

     1.    a.  The governing body of a county or municipality operating under the provisions of Title 11A of the New Jersey Statutes may rescind the adoption of Title 11A by ordinance or resolution, as appropriate; provided, however, that an employee with permanent status in a title on the date rescission takes effect shall retain such career service rights for as long as the Civil Service Commission shall by regulation provide and veterans, as defined by N.J.S.11A:5-1 and including spouses and parents of such veterans, shall retain the preference and rights pertaining to appointment, promotion, layoff, dismissal, and discrimination as provided in N.J.S.11A:5-1 et seq.

     b.    If the governing body of a county or municipality rescinds the adoption of Title 11A of the New Jersey Statutes by ordinance or resolution, as appropriate, the rescission shall be certified by the clerk of the county or municipality to the New Jersey Civil Service Commission.  The rescission shall take effect six months following passage of the ordinance.  The commission shall promulgate regulations providing for the orderly transition in the personnel system of the county or municipality during that six-month period. If a governing body rejects an ordinance or resolution to rescind the adoption of Title 11A of the New Jersey Statutes, a new vote by the governing body on an ordinance or resolution to rescind shall not be held for a period of at least five years following the rejection of rescission.

     c.     A county or municipality that rescinds the adoption of the provisions of Title 11A of the New Jersey Statutes by adoption of an ordinance or resolution shall not be permitted to readopt the provisions of that title for a period of at least five years from the effective date of the rescission and shall be permitted to readopt the provisions of Title 11A of the New Jersey Statutes only once.  A readoption of the provisions of Title 11A, pursuant to this section, shall be conducted in the same manner provided for the adoption thereof contained in N.J.S.11A:9-1 et seq.

     d.    The Civil Service Commission shall promulgate regulations for the proper administration and enforcement of N.J.S.11A:5-1 et seq. in a county or municipality that rescinds the adoption of the provisions of Title 11A of the New Jersey Statutes.  The commission shall be responsible for the enforcement of the law and regulations regarding administration of N.J.S.11A:5-1 et seq.

 

     2.    This act shall take effect immediately.

STATEMENT

 

     This bill permits counties and municipalities to withdraw from the civil service system.  It provides that the governing body of a county or municipality operating under the provisions of Title 11A (Civil Service) of the New Jersey Statutes may rescind the adoption of Title 11A by ordinance or resolution, as appropriate; provided, however, that an employee with permanent status in a title on the date rescission takes effect will retain such career service rights for as long as the Civil Service Commission provides by regulation.

     The bill requires a county or municipality that withdraws to maintain the preference and rights of veterans pertaining to appointment, promotion, layoff, dismissal and discrimination as provided by Title 11A.

     If the governing body of a county or municipality rescinds the adoption of Title 11A, the rescission will take effect six months following the passage of the ordinance or resolution.  The New Jersey Civil Service Commission will promulgate regulations providing for the orderly transition in the personnel system of the county or municipality during that six-month period.
