SYNOPSIS
Requires municipal approval prior to issuance of special concessionaire permit.

An Act concerning the special concessionaire permit and amending R.S.33:1-42.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. R.S.33:1-42 is amended to read as follow:
33:1-42. No sales of alcoholic beverages shall be made in any public buildings belonging to or under the control of the [state] State or any political subdivision thereof except as to the national guard as hereinbefore provided, and except as permitted by the [commissioner] director in specified cases and subject to rules and regulations.
Prior to the issuance of a special concessionaire permit by the director pursuant to the provisions of this section, the applicant shall obtain the approval of the governing body of the municipality where the public building is situated.

2. This act shall take effect immediately.
STATEMENT
This bill requires municipal approval prior to the issuance of a special concessionaire permit by the Director of Alcoholic Beverage Control.
Current law and regulations of the director permit the director to authorize the sale of alcoholic beverages in public buildings owned or controlled by the State or any political subdivision, except for the National Guard. The director may issue a Special Concessionaire Permit to a private vendor who has a contract with the governmental unit to provide services to the public. There is a fee of $2,000 for the annual permit.
Prior to filing the application for the permit with the director, the applicant is required to publish notice in a newspaper circulated in the municipality where the public building is located, or the county if there is no newspaper in that municipality. Under the provisions of this bill, the applicant also will be required to obtain the approval of the municipality before the permit may be issued by the director.
