SYNOPSIS
Redirects vehicle surcharge revenues for Autism Medical Research and Treatment Fund to support children with Autism Spectrum Disorder and other developmental delays and disabilities enrolled in the Early Childhood Intervention Program.

A Supplement to "An Act making appropriations for the support of the State Government and the several public purposes for the fiscal year ending June 30, 2012 and regulating the disbursement thereof," approved June 30, 2011 (P.L.2011, c.85).
Be It Enacted by the Senate and the General Assembly of the State of New Jersey:
1. The following language is added on page 79 of P.L.2011, c.85:

Notwithstanding the provisions of subsection f. of R.S.39:5-41 to the contrary, all monies generated by the $1 charge added to the amount of each fine and penalty imposed and collected through a court under authority of any law for any violation of the provisions of Title 39 of the Revised Statutes or any other motor vehicle or traffic violation in this State, for the purpose of funding the "Autism Medical Research and Treatment Fund," shall be used to support the Early Childhood Intervention Program.
2. This act shall take effect immediately and shall be retroactive to July 1, 2011.
STATEMENT
The FY 2011 appropriations act required families who receive Early Childhood Intervention Program (ECIP) services to pay more for those services. Also, families with incomes of under 350% of the federal poverty level would now be subject to a co-payment. These policies were continued in the FY2012 appropriation act.
This bill redirects approximately $4 million that is generated from a $1 motor vehicle surcharge for the "Autism Medical Research and Treatment Fund" to support ECIP. These monies will enable ECIP to reduce the increase in co-payment amounts and may enable families with incomes of less than 350% of the federal poverty level to avoid a new co-payment requirement.
Available information is that the "Autism Medical Research and Treatment Fund" has sufficient unexpended balances available to continue its activities without the $4 million that would be raised from this $1 motor vehicle surcharge in FY 2012.
