SYNOPSIS
Provides for tattoo pigment labeling requirements.

An Act concerning the practice of tattooing and supplementing Title 26 of the Revised Statutes.
Be It Enacted by the Senate and General Assembly of the State of New Jersey:
1. a. The Commissioner of Health and Senior Services shall prescribe by regulation:
(1) labeling requirements for pigments used in the practice of tattooing that clearly indicate the chemical ingredients of each pigment used;
(2) procedures for the conduct of inspections or investigations of any premises for the rendering of any tattooing service to ensure compliance with the labeling requirements prescribed by the commissioner; and
(3) monetary penalties for failure to comply with those labeling requirements, in addition to providing for suspension or revocation of a license issued to a tattoo parlor by the Department of Health and Senior Services for repeated violations of the labeling requirements.
b. As used in this act, "tattooing" means the insertion of pigment under the surface of the skin of a person, by pricking with a needle or otherwise, to produce an indelible mark or figure visible through the skin.
2. The Commissioner of Health and Senior Services, pursuant to the "Administrative Procedure Act," P.L.1968, c.410 (C.52:14B-1 et seq.), shall adopt rules and regulations to effectuate the purposes of this act.
3. This act shall take effect on the 180th day after enactment, but the Commissioner of Health and Senior Services may take such anticipatory administrative action in advance thereof as shall be necessary for the implementation of the act.
STATEMENT
This bill directs the Commissioner of Health and Senior Services to prescribe by regulation labeling requirements for pigments used in the practice of tattooing that clearly indicate the chemical ingredients of each pigment used.
The commissioner is further directed to prescribe:
-- procedures for the conduct of inspections or investigations of any premises for the rendering of any tattooing service to ensure compliance with the labeling requirements prescribed by the commissioner; and
-- monetary penalties for failure to comply with those labeling requirements, in addition to providing for suspension or revocation of a license issued to a tattoo parlor by the Department of Health and Senior Services for repeated violations of the labeling requirements.
The bill defines "tattooing" to mean the insertion of pigment under the surface of the skin of a person, by pricking with a needle or otherwise, to produce an indelible mark or figure visible through the skin.
The bill takes effect on the 180th day after enactment, but authorizes the Commissioner of Health and Senior Services to take anticipatory administrative action in advance as necessary for its implementation.
