This bill establishes a school lunch meal program fund for the purpose of providing financial support to any school district that lacks sufficient funding to provide school lunches to needy children who are unable to pay the full cost of the lunch.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT establishing a fund to provide financial assistance to school districts for school lunch programs.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  State Board; Food and Nutrition Programs.  Amend RSA 189:11-a, I to read as follows:

I.(a)  Each school board shall make a meal available during school hours to every pupil under its jurisdiction.  Such meals shall be served without cost or at a reduced cost to any needy child who is unable to pay the full cost of said meals.  The state board of education shall insure compliance with this section and shall establish minimum nutritional standards for such meals and shall further establish income guidelines setting forth the minimum family size annual income levels to be used in determining eligibility for free and reduced price meals.  Nothing in this section shall prohibit the operation of both a breakfast and lunch program in the same school.  Further any requirement of this section which conflicts with any federal statute or regulation may be waived by the state board of education.

(b)  There is established in the office of the state treasurer a fund to be known as the school lunch meal program fund.  The fund shall consist of such moneys as may be appropriated and shall include federal and other non-state source grants or funds received.  The fund shall be kept distinct and separate from all other funds and shall be administered by the commissioner of the department of education.  All moneys in the fund shall be continually appropriated to the commissioner for the purpose of providing financial support to any school district that lacks sufficient funding to provide school lunches to needy children who are unable to pay the full cost of the lunch.

2  New Subparagraph; Application of Receipts; School Lunch Meal Program Fund.  Amend RSA 6:12, I(b) by inserting after subparagraph (331) the following new subparagraph:

(332)  Moneys deposited into the school lunch meal program fund established in RSA 189:11-a, I(b).  

3  Effective Date.  This act shall take effect 60 days after its passage.
