STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Three
AN ACT requiring trauma kits to be available in state-owned buildings.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Subdivision; Emergency Medical and Trauma Services; Trauma Kit. Amend RSA 153-A by inserting after paragraph 33 the following new subdivision:
Trauma Kit
153-A:33-a Trauma Kit.
I. A trauma kit shall be installed and readily available in state-owned buildings. The state-owned buildings and order of installation shall be identified by the trauma kit placement committee established in RSA 153-A:33-d.
II. In this section, "trauma kit" means a first aid response kit that contains at least all of the following:
(a) One tourniquet.
(b) One bleeding control bandage.
(c) One pair of nonlatex protective gloves and a pen type marker.
(d) One pair of blunt-ended scissors.
(e) Instructional documents developed by the Stop the Bleed national awareness campaign of the United States Department of Homeland Security or the American College of Surgeons Committee on Trauma, the American Red Cross, the Committee for Tactical Emergency Casualty Care, or any other partner of the United States Department of Defense.
III. Medical materials and equipment similar to those described in subparagraphs I(a) to (d), and any additional items that are approved by the local EMS medical control, as defined in RSA 153-A:2, XV(a), may be included as supplements in addition to the items described in subparagraphs I(a) to (d), if they adequately treat a traumatic injury and can be stored in a readily available kit.
IV. Nothing in this section shall require a property manager or person employed by a property managing entity on behalf of the state to respond to an emergency with the use of trauma kits.
V. This section shall not apply to a state-owned building that is vacant or under construction or renovation.
153-A:33-b Liability Limited. Any person who, in good faith and without compensation, renders emergency care by the use of a trauma kit shall not be liable for civil damages for any acts or omissions unless the acts or omissions were grossly negligent or purposeful.
153-A:33-c Trauma Kit Fund. There is established in the department of safety, division of fire standards and training and emergency medical services a trauma kit fund, which shall be kept separate and distinct from all other funds. The fund shall be nonlapsing and continually appropriated to the division for the purposes of this subdivision. With the approval of the commissioner, the division may accept in the name of the state funds from any source, including gifts, grants, and donations, for the purpose of purchasing the trauma kits described in this subdivision. All expenditures from the fund shall be made available to the public upon request.
153-A:33-d Trauma Kit Placement Committee. There is established a committee within the department of safety, division of fire standards and training and emergency medical services, to identify the state-owned buildings in which the trauma kits shall be installed, to develop criteria for the order of placement, and to develop a schedule for future placements. The committee shall consist of a representative from the department of safety’s bureau of emergency medical services, the emergency medical services medical control board established in RSA 153-A:5, and the department of administrative services, appointed by the commissioner.
2 New Subparagraph; Application of Receipts; Trauma Kit Fund. Amend RSA 6:12, I(b) by inserting after subparagraph (387) the following new subparagraph:
(388) Moneys deposited in the trauma kit fund established in RSA 153-A:33-c.
3 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:
This bill requires a trauma kit be installed and readily available in all state-owned buildings and creates a dedicated fund for purchasing said kits within the Department of Safety, Division of Fire Standards and Training and Emergency Medical Services.
Based on information provided by the Department of Administrative Services and Department of Safety, trauma kits under this bill may costs anywhere between $80 and $200 (depending on kit type needed at each location) and there are approximately 340 to 440 locations (including state leased buildings, such as liquor stores) for which a trauma kit would be required. Therefore, this bill would have an initial cost between $27,200 ($80 kit X 340 locations) and $88,000 ($200 kit X 440 locations). This initial cost is assumed to be incurred in FY 2024, however upkeep and replacement of units in FY 2025 and each year thereafter is indeterminable as those costs cannot be estimated at this time.
It should be noted this bill provides neither an appropriation nor a source of funds for the new dedicated fund for the purchase of any trauma kits.
