STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Three

 

AN ACT relative to permits for the siting of new landfills.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Unrestricted Service Area Landfill; Restriction.  Amend RSA 149-M:9, V-a to read as follows:

V-a. The department shall not issue a permit for the construction of a new landfill or unrestricted landfill, excluding the expansion of existing landfills, unless the department makes a positive determination that the permit application is consistent with the state's solid waste plan that has been updated consistent with the requirements of RSA 149-M:29.

2  Effective Date.  This act shall take effect 60 days after its passage.
