STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Nineteen
AN ACT relative to lucky 7 tickets.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Lucky 7 Ticket Prices. Amend RSA 287-E:20, II to read as follows:
II. The price of any lucky 7 ticket pack or ticket card shall not exceed [$.50 ] $2.
2 Sale of Lucky 7 Tickets. Amend RSA 287-E:21, III-a to read as follows:
III-a. Lucky 7 tickets may be sold by dispenser devices approved by the commission and located at the regular meeting place of, or at a facility owned, leased, or utilized by, the licensee for its activities, provided that the commission shall not authorize the use of any lucky 7 dispenser device which was not in use on or before January 1, 2011, unless such device dispenses, or is capable of dispensing at the player's request, a paper or cardboard ticket [which has a manual break-open feature] and specifications for such dispenser device are contained in the rules of the commission. Any permitted lucky 7 device shall not be in the nature of a slot machine and the outcome of any wager involving a permitted lucky 7 device shall be determined and displayed solely by and on the cardboard or paper ticket or on the screen of the device.
3 Lucky 7 Fees. Amend RSA 287-E:22, I to read as follows:
I. A licensed distributor shall pay a fee of $15 per deal of pull tab tickets or $0.0043 per pull tab ticket in a deal, whichever is greater.
4 Definitions; Deal; Lucky 7. Amend RSA 287-E:16-a, II to read as follows:
II. "Deal" means either a box or bag of lucky 7 tickets, containing [a certain count of] uncirculated tickets bearing a serial number. The commission may approve larger deal sizes upon request at its discretion through the adoption of rules under RSA 541-A.
5 Rulemaking; Lucky 7 Deals. Amend RSA 287-E:18, IX to read as follows:
IX. Approval of deal sizes.
X. Other matters related to the proper administration of this chapter.
6 Effective Date. This act shall take effect upon its passage.

METHODOLOGY:
This bill changes the limit on the maximum price of a lucky 7 tickets to $2 from $0.50; allows the player to choose whether a paper ticket is dispensed when purchased from an electronic ticket dispensing device; and converts the deal fee structure from a $15.00 per deal fee to $15.00 per deal or $0.0043 per ticket fee, whichever is greater. This bill will impact state revenue by an indeterminable amount depending on the following factors:
- An increase in maximum ticket price allowed by this bill could create more robust prize structures to increase demand from players, but may also decrease the total number of players, if players find the increased price too high.
- The Commission, which currently limits deal sizes to not exceed 3,500 tickets per deal, may increase the number of tickets allowed in deal size and receive an increase in revenue above the $15 deal fee in current law.
Pursuant to RSA 284:21-j, I, Lottery Fund balance, or net profit, shall be deposited in the Education Trust Fund at the end of the fiscal year. Therefore, any impact on revenue to the Lottery Fund will impact the Education Trust Fund.
The Lottery Commission does not anticipate this bill to result in an increase in state expenditures, although some Commission procedures will need to be modified.
