ANALYSIS
This bill clarifies the ongoing nature of the memorandum of agreement between the department of environmental services and the department of health and human services regarding data sharing practices. The bill also changes the reporting requirement from 6 months to an annual basis and requires it to be submitted to the commission on the environmental and public health impacts of PFAS.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Three
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Data Sharing Between the Department of Environmental Services and the Department of Health and Human Services; Memorandum of Agreement. Amend RSA 126-A:76, I(a) to read as follows:
(a) Enter into [an updated] a standing memorandum of agreement on cooperation regarding data sharing between the department of health and human services and the department of environmental services. The memorandum of agreement shall not lapse and shall be updated as necessary to ensure that the data sharing practices remain in effect, without interruption.
2 Data Sharing Between the Department of Environmental Services and the Department of Health and Human Services; Memorandum of Agreement; Reporting Requirement. Amend RSA 126-A:76, III to read as follows:
III. On or before September 1, 2019, and at a minimum every [6 months] year thereafter, the commissioners of the department of environmental services and the department of health and human services shall submit a report regarding the data sharing practices required under paragraph I to the speaker of the house of representatives, the senate president, the state library, the commission on the environmental and public health impacts of per- and polyfluorinated alkyl substances, established in RSA 126-A:79-a, and the commission to study environmentally-triggered chronic illness. [The report shall include results of the 2-way pilot project between the departments on arsenic in drinking water, where both health effects and environmental data exist.]
3 Effective Date. This act shall take effect 60 days after its passage.
