STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Eleven

AN ACT making an appropriation for funding disaster relief and hazard mitigation in response to the May 2006 Suncook River avulsion.

Be it Enacted by the Senate and House of Representatives in General Court convened:

1 Appropriation. A sum of up to $7,050,000 for the fiscal year ending June 30, 2012 is hereby appropriated to the department of transportation to mitigate and resolve the severe and hazardous environmental conditions resulting from the May 2006 Suncook River avulsion as follows: up to $50,000 for an engineering study to determine the preferred solution to the ongoing erosion, sediment migration, and expanding floodplain; up to $1,000,000 to dredge the Suncook River below the avulsion to restore the downstream bankfull cross-sections to the pre-avulsion levels; and up to $6,000,000 to complete the preferred solution as determined by the engineering study. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.

2 Effective Date. This act shall take effect July 1, 2011.

HB 287-FN-A - FISCAL NOTE

AN ACT making an appropriation for funding disaster relief and hazard mitigation in response to the May 2006 Suncook River avulsion.

FISCAL IMPACT:

The Department of Transportation states this bill will increase state general fund expenditures by $7,050,000 in FY 2012. There will be no fiscal impact on county and local expenditures or state, county, and local revenues.

This bill appropriates $7,050,000 from the state general fund in FY 2012.

METHODOLOGY:

The Department of Transportation states the proposed legislation will appropriate a total of $7,050,000 of general funds for funding disaster relief and hazard mitigation in response to the May 2006 Suncook River avulsion. The Department notes that the proposed legislation allocates the appropriation in such a manner that no more than $50,000 may be allocated towards associated engineering studies, no more than $1,000,000 may be allocated towards dredging of the Suncook River, and no more than $6,000,000 may be allocated towards the construction of the engineering study’s preferred alternative.
