STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Two

 

AN ACT requiring partial audits of additional offices on ballots involved in recounts.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; General Provisions for Recounts; Partial Audits.  Amend RSA 660 by inserting after section 17 the following new section:

660:17-a  Partial Audits of Additional Offices on Ballots Involved in Recounts.  

I.  For each official recount, the secretary of state shall conduct a partial audit of either one or 2 additional offices on those ballots involved in the recount.

II.  The secretary of state or designee shall select one of the top-of-ballot offices to be audited on all ballots of every recount to be held, either President, United States Senate, United States House of Representatives, governor or executive council.  The selection shall apply on any subsequent recount requested during the same election cycle.

III.  The candidate applying for the recount may select any other office involved in his or her recount.  

IV.  A discrepancy of greater than one percent shall be justification for affected candidates to request a full recount of that race.

2  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill requires the Secretary of State to conduct partial audits of additional offices on ballots involved in recounts.  The Department of State indicates there would be an indeterminable increase of state expenditures in order to comply with the provisions in the bill.  The partial audits would require an increase in staff and in space necessary to conduct the recounts.  The amount of additional staff required would be dependent on the number and size of the recounts.

 

It is assumed the fiscal impact would not occur until FY 2023.
