A BILL TO BE ENTITLED

AN ACT to require cities and counties to remove personal information from tax records available to the public on an internet web site when requested by law enforcement or a district attorney.

The General Assembly of North Carolina enacts:

SECTION 1.  Article 7 of Chapter 153A of the General Statutes is amended by adding a new section to read:

"§ 153A‑148.2.  Removal of personal information from public Web sites; law enforcement and district attorneys.

Each county shall develop and make available a process by which a law enforcement officer, a district attorney, or an assistant district attorney may request that the county remove the individual's personal information, including address and phone number, from any Internet Web site maintained by the county and available to the general public that displays local tax records. The request must specify the personal information to be removed from the Web site. The county must remove the information if properly requested under this section. Information removed from the Web site continues to be a public record if it would otherwise be a public record under Chapter 132 of the General Statutes."

SECTION 2.  Article 9 of Chapter 160A of the General Statutes is amended by adding a new section to read:

"§ 160A‑208.2.  Removal of personal information from public Web sites; law enforcement and district attorneys.

Each city shall develop and make available a process by which a law enforcement officer, a district attorney, or an assistant district attorney may request that the city remove the individual's personal information, including address and phone number, from any Internet Web site maintained by the city and available to the general public that displays local tax records. The request must specify the personal information to be removed from the Web site. The city must remove the information if properly requested under this section. SECTION 3. This act is effective when it becomes law.
