Senate Bill 2707

AN ACT TO AMEND SECTION 37-151-6, MISSISSIPPI CODE OF 1972, TO REQUIRE THE LEGISLATURE TO FULLY FUND THE MISSISSIPPI ADEQUATE EDUCATION PROGRAM; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 37-151-6, Mississippi Code of 1972, is amended as follows:

     37-151-6.  (1)  Effective with fiscal year * * * 2007 2023, the Legislature shall fully fund the Mississippi Adequate Education Program and shall appropriate funds to do so.

     (2)  The mandatory duty to fully fund the MAEP, imposed by subsection (1) of this section, is not voided by any provision of law that references the MAEP not being fully funded in any particular year.

     (3)  The mandatory duty to fully fund the MAEP, imposed by subsection (1) of this section, is not voided, amended or suspended by the Legislature passing an appropriations bill that does not fulfill the duty to fully fund the MAEP.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2022.
