House Bill 745

AN ACT MAKING AN APPROPRIATION TO THE STATE DEPARTMENT OF EDUCATION FOR THE PURPOSE OF FUNDING ADDITIONAL SPECIALIZED INSTRUCTIONAL SUPPORT PERSONNEL IN THE SCHOOL DISTRICTS TO ADDRESS IMMEDIATE INCREASED NEEDS DUE TO THE COVID-19 PANDEMIC FOR THE FISCAL YEAR 2022; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:     SECTION 1.  (1)  The following sum, or so much of it as may be necessary, is appropriated out of any money in the State General Fund not otherwise appropriated, to the State Department of Education for the purpose of providing funding for specialized instructional support personnel positions for the fiscal year beginning July 1, 2021, and ending June 30, 2022..................

................................................. $  2,000,000.00.

     (2)  The money appropriated by this act shall be in addition to the funds provided to the State Department of Education in the annual appropriation to the department for fiscal year 2022, for the purpose of funding, above the level provided during the fiscal year 2021, additional specialized instructional support personnel positions, including school psychologists, guidance counselors, social workers and nurses, in the school districts to address the immediate increased need for services to students and their families and school district personnel due to the COVID-19 pandemic.

     (3)  The State Board of Education shall allocate funds appropriated under this act to the school districts according to a formula developed by the board which provides for the equitable provision of additional services according to factors including, but not limited to, average daily attendance, currently existing availability of such services, and demonstrable need for additional support, with consideration given to school districts' instruction being delivered in person, virtually or through a hybrid model.

     SECTION 2.  The money appropriated by this act shall be paid by the State Treasurer out of any money in the State Treasury to the credit of the proper fund or funds as set forth in this act, upon warrants issued by the State Fiscal Officer, and the State Fiscal Officer shall issue the warrants upon requisitions signed by the proper person, officer or officers in the manner provided by law.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2021.
