House Bill 1178

AN ACT TO AMEND SECTION 1 OF CHAPTER 309, LAWS OF 1966, AS AMENDED BY CHAPTER 496, LAWS OF 1982, AS AMENDED BY CHAPTER 576, LAWS OF 2000, TO AUTHORIZE THE NORTHEAST MISSISSIPPI NATURAL GAS DISTRICT TO EXPAND ITS GAS DISTRIBUTION SERVICES INTO CERTAIN PORTIONS OF LEE AND MONROE COUNTIES; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Section 1, Chapter 309, Laws of 1966, as amended by Chapter 496, Laws of 1982, as amended by Chapter 576, Laws of 2000, is amended as follows:

Section 1. The Northeast Mississippi Gas District is hereby created, said district being composed of the following described areas:

(a) All that part of Itawamba County, Mississippi, lying west of the Tombigbee River;

(b) That portion of Lee County lying within one-half (1/2) mile on either side of the center line of State Highway 363, extending a distance of five (5) miles west from the county line dividing Itawamba and Lee Counties;

(c) That portion of Lee County lying within one-half (1/2) mile on either side of the center line of U.S. Highway 78, extending a distance of five (5) miles west from the county line dividing Itawamba and Lee Counties, and the unincorporated community of Mooreville in Lee County; and

(d) That portion of Lee County lying within one-half (1/2) mile on either side of the center line of State Highway 371 (being the highway from Mantachie to Mooreville), extending a distance of five (5) miles southwest from the county line dividing Itawamba and Lee Counties.

(e) That portion of Lee County comprising the East one half of Sections 23, 26, and 35 Township 7 South, Range 6 East and that portion of Lee County comprising the north one half of Section 2, Sections 1 and 12, Township 8 South, Range 6 East; and that portion of Lee County comprising Section 13, Township 8 South, Range 6 East located more than one half mile north of Highway 363, and Section 18, Township 8 South, Range 7 East located more than one half mile north of Highway 363; and that portion of Lee County comprising Sections 6 and 7, Township 8 South, Range 7 East; and that portion of Lee County comprising Sections 24, 25 and 36, Township 7 South, Range 6 East; and that portion of Lee County comprising Sections 19, 30, and 31, Township 7 South, Range 7 East.

(f) That portion of Lee County comprising Sections 7, 8, 17, 18, 19, 20, 29, 30, 31, and 32, Township 10 South, Range 7 East; and that portion of Lee County comprising Sections 3, 4, 5, 6, 7, 8, 9, 10, 15, 16, 17, and 18 and the north three quarters of Sections 19, 20, 21, and 22 Township 11 South, Range 7 East; and that portion of Lee County comprising Sections 1, 2, 12, and 13 and Sections 3, 11, and 14 east of the Burlington Northern Railroad and the north three quarters of Section 23 east of the Burlington Northern Railroad, and the north three quarters of Section 24, Township 11 South, Range 6 East; and that portion of Lee County comprising the south one quarter of Sections 22, 23, 24, and Sections 25, 26, 35, and 36, and Sections 27 and 34 east of the Burlington Northern Railroad, Township 10 South, Range 6 East.

(g) That portion of Monroe County comprising Section 36, Township 11 South, Range 7 East; and that portion of Monroe County comprising Sections 1, 12, and 13 Township 12 South, Range 7 East; and that portion of Monroe County comprising Sections 31, 32, 33, and 34 and Section 35 west of the Tombigbee River, Township 11 South, Range 8 East; and that portion of Monroe County comprising Sections 5, 6, and 7 and Sections 3, 4, 8 and 18 west of the Tombigbee River, Township 12 South, Range 8 East.

SECTION 2. This act shall take effect and be in force from and after its passage.
