1.2relating to education; authorizing a lease levy for administrative space for
1.3Independent School District No. 284, Wayzata.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. LEASE LEVY; ADMINISTRATIVE SPACE; WAYZATA.
1.6Notwithstanding Minnesota Statutes, section 126C.40, subdivision 1, Independent
1.7School District No. 284, Wayzata, may lease administrative space under Minnesota
1.8Statutes, section 126C.40, subdivision 1, if the district can demonstrate to the satisfaction
1.9of the commissioner of education that the administrative space is less expensive than
1.10instructional space that the district would otherwise lease. The commissioner must
1.11deny this levy authority unless the district passes a resolution stating its intent to lease
1.12instructional space under Minnesota Statutes, section 126C.40, subdivision 1, if the
1.13commissioner does not grant authority under this section. The resolution must also certify
1.14that a lease of administrative space under this section is less expensive than the district's
1.15proposed instructional lease. Levy authority under this section shall not exceed the total
1.16levy authority under Minnesota Statutes, section 126C.40, subdivision 1, paragraph (e).
1.17EFFECTIVE DATE.This section is effective for taxes payable in 2012 and later.
