1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.6 Section 1. Minnesota Statutes 2012, section 169.86, subdivision 3b, is amended to read:
1.7 Subd. 3b. Escort vehicles. (a) The commissioner or local authority shall specify
1.8in the permit:
1.9(1) the minimum number of escort vehicles required to escort the overdimensional
1.10load; and
1.11(2)whether any requirements relating to flashing warning lights.
1.12(b) The permit must state that the operators of the escort vehiclesmust:
1.13(1) may be certified licensed peace officers or certified protective agents licensed
1.14under sections 326.32 to 326.339, or both, at the discretion of the applicant; or
1.15(2) may be overdimensional load escort drivers who hold a license under section
1.16326.3382, subdivision 5, and who hold a current certificate under section299D.085 .
1.17(c) The commissioner of transportation may not adopt a rule or other regulation
1.18that directly or indirectly:
1.19(1) bars licensed protective agents from performing traffic control duties under
1.20section 326.338, subdivision 4, clause (4); or
1.21(2) results in a preference for a licensed peace officer or a licensed protective agent
1.22in the provision of overdimensional load escort services.
2.1EFFECTIVE DATE.Paragraphs (a) and (b) are effective on the same day as the
2.2effective date of Laws 2010, chapter 311, section 2. Paragraph (c) is effective the day
2.3following final enactment.
