Synopsis: Alcohol trainer programs and server programs. Allows the alcohol and tobacco commission (commission) to establish an alcohol server trainer program. Requires the commission to approve alcohol server trainer programs by third parties. (Current law allows the commission to approve alcohol server trainer programs by third parties.) Establishes requirements for alcohol server trainer programs. Requires the commission to post all of the approved alcohol server trainer programs and alcohol server programs on the commission's Internet web site. Removes provisions that: (1) prohibit the commission from approving alcohol server trainer programs by third parties that hold or have an interest in certain alcoholic beverage permits; and (2) establish factors the commission may consider in approving an alcohol server trainer program.

SENATE BILL No. 258



    A BILL FOR AN ACT to amend the Indiana Code concerning alcohol and tobacco.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 7.1-3-1.5-5.5; (12)SB0258.1.1. -->     SECTION 1. IC 7.1-3-1.5-5.5, AS ADDED BY P.L.94-2008, SECTION 18, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2012]: Sec. 5.5. (a) Subject to subsection (b), The commission: may:
         (1) may establish a trainer program; and
         (2) shall approve a trainer program by a third party that:
             (A) meets:
                (i) the requirements under subsection (b); and
                (ii) any other requirements established by the commission under this chapter; and
            (B)
is designed to educate individuals on the training of alcohol servers on the selling, serving, and consumption of alcoholic beverages.
    (b) The commission may not approve a trainer program by a third party that holds or has an interest in any of the following permits:
        (1) A primary source of supply permit.
        (2) A beer, wine, or liquor wholesaler's permit.
        (3) A beer, wine, or liquor retailer's permit.
        (4) A beer, wine, or liquor dealer's permit.
    (c) In approving a trainer program under this section, the commission may consider the following factors:
        (1) The needs of applicants.
        (2) The geographical distribution of the third parties' locations in Indiana.
        (3) The adequacy of the facilities where the trainer program will be conducted.
     (b) A trainer program approved under subsection (a) must:
        (1) provide for answering questions from individuals who attend the trainer program; and
        (2) include the following:
            (A) Instruction on how to teach and information that is required to be taught in a server program.
            (B) A trainer workbook or guide that is provided to the individuals who attend the trainer program that contains information required to be taught in a server program.
            (C) Information on the requirements for applicants and certified trainers under this chapter.
            (D) An exam that covers trainer program and server program curriculum.
