Synopsis: Duplication of automobile keys. Requires a person that provides key duplicating services to require an individual who requests a duplicate key for a passenger motor vehicle to provide the following: (1) a valid driver's license or identification card; and (2) a registration for the vehicle issued to the individual requesting the duplicate key.

    A BILL FOR AN ACT to amend the Indiana Code concerning trade regulation.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 24-5-27; (11)IN1515.1.1. -->     SECTION 1. IC 24-5-27 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2011]:
    Chapter 27. Duplication of Motor Vehicle Keys
    Sec. 1. As used in this chapter, "key duplicater" means a person who provides key duplicating services. The term includes:
        (1) a locksmith; and
        (2) a dealer (as defined in IC 9-13-2-42(a)).
    Sec. 2. As used in this chapter, "passenger motor vehicle" has the meaning set forth in IC 9-13-2-123.
    Sec. 3. Before a key duplicater may duplicate a key used to unlock or operate a passenger motor vehicle, the key duplicater must obtain from the individual requesting the duplicate key:
        (1) a current and valid:
            (A) Indiana driver's license issued under IC 9-24;
            (B) Indiana identification card for nondrivers issued under IC 9-24-16; or
            (C) a driver's license or identification card issued by another state that is substantially similar to a license or card described in clause (A) or (B); and
        (2) a registration for the passenger motor vehicle issued under IC 9-18-2 or under a similar law of another state indicating that the passenger motor vehicle is registered to the individual.
    Sec. 4. A person who violates section 3 of this chapter commits a Class B infraction.
