Synopsis: Wind energy conversion systems. Provides that a unit of local government that adopts an ordinance regulating wind energy conversion systems (WECS) must include a requirement that a WECS tower be constructed of Indiana steel. Provides that the ordinance may exclude a WECS that generates electricity solely for private use.

HOUSE BILL No. 1351



    A BILL FOR AN ACT to amend the Indiana Code concerning utilities.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 36-7-4-1514; (11)IN1351.1.1. -->     SECTION 1. IC 36-7-4-1514 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2011]: Sec. 1514. (a) As used in this section, "steel products" means products rolled, formed, shaped, drawn, extruded, forged, cast, fabricated, or otherwise similarly processed, or processed by a combination of two (2) or more of such operations, from steel made in Indiana by the open hearth, basic oxygen, electric furnace, Bessemer, or other steel making process.
    (b) As used in this section, "WECS tower" means the support structure to which the generator and rotor of a WECS are attached.
    (c) As used in this section, "wind energy conversion system (WECS)" means all necessary devices, including generators and rotors, that:
        (1) convert wind energy into electricity; and
        (2) deliver the electricity to a utility's transmission lines.
    (d) A unit that adopts an ordinance regulating WECS must

include in the ordinance a requirement that a WECS tower be manufactured from Indiana steel. The ordinance:
        (1) must set forth the criteria that the unit will use to determine whether a WECS tower is manufactured from Indiana steel; and
        (2) may exclude from its application a WECS that generates electricity solely for private use.
