Synopsis: BMV reciprocal agreements with foreign countries. Authorizes the bureau of motor vehicles (BMV) to negotiate and enter into reciprocal agreements or arrangements with a foreign county to facilitate the exchange of driver's licenses or permits. Requires the BMV to report annually regarding reciprocal agreements entered into under this chapter to the general assembly before February 1 of each year.

HOUSE BILL No. 1313



    A BILL FOR AN ACT to amend the Indiana Code concerning motor vehicles.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 9-28-5.1; (10)IN1313.1.1. -->     SECTION 1. IC 9-28-5.1 IS ADDED TO THE INDIANA CODE AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2010]:
     Chapter 5.1. International Reciprocity
    Sec. 1. To facilitate the exchange of driver's licenses or permits, the bureau may negotiate and enter into reciprocal agreements or arrangements with a foreign county if:
        (1) the requirements governing the granting of a license or permit to operate a motor vehicle are similar to or more stringent than the requirements of the bureau;
        (2) the foreign country provides for similar reciprocity for an operator who is licensed in Indiana who applies for the equivalent of a driver's license or permit in the foreign country; and
        (3) there is a recognized need for reciprocity.
    Sec. 2. A reciprocal agreement entered into under section 1 of this chapter must authorize the bureau to allow an individual who

possesses the equivalent of a driver's license or permit to obtain a driver's license or permit from the bureau.
     Sec. 3. After a reciprocal agreement is entered into under section 1 of this chapter, the bureau may not require an individual who is an applicant for a driver's license or permit under the authority granted by the reciprocal agreement to submit to an examination other than that required by IC 9-24-10-4(a)(1). However, IC 9-24-10-4(b) applies to an applicant for a driver's license or permit under this section.
    Sec. 4. The bureau shall report annually in an electronic format under IC 5-14-6 regarding reciprocal agreements entered into under this chapter to the general assembly before February 1 of each year.
    Sec. 5. The bureau may adopt rules under IC 4-22-2 to carry out this chapter.
