DIGEST OF INTRODUCED BILL

Synopsis: Certified music therapists. Provides that an individual may
not profess to be a certified music therapist unless the individual holds
and maintains the credentialing administered by the Certification Board
for Music Therapists (CBMT). Provides that an individual who
practices music therapy without the CBMT credentialing commits a
Class B misdemeanor. Makes a technical correction.
Effective: July 1, 2012.

A BILL FOR AN ACT to amend the Indiana Code concerning
professions and occupations.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 25-23.9 IS ADDED TO THE INDIANA CODE AS
A NEW ARTICLE TO READ AS FOLLOWS [EFFECTIVE JULY 1,
2012]:
ARTICLE 23.9. MUSIC THERAPISTS
Chapter 1. Definitions
Sec. 1. As used in this article, "music therapy" means the clinical and evidence-based use of music interventions to accomplish individualized goals within a therapeutic relationship by a credentialed professional who has completed an approved music therapy program.
Sec. 2. As used in this article, "practitioner" means a person who holds:
(1) an unlimited certificate;
(2) a limited or probationary certificate;
(3) a temporary certificate; or
(4) an intern certificate;
issued by a board regulating a profession or an occupation.
Chapter 2. Activity by Noncertified Individuals
Sec. 1. This chapter does not prohibit a practitioner from performing music therapy functions if the practitioner is acting within the scope of the practitioner's certificate.
Sec. 2. Except as provided in section 1 of this chapter, an individual may not:
(1) profess to be a certified music therapist or music therapist;
(2) use the initials "MT-BC" or any other words, letters, abbreviations, or insignia indicating or implying that the individual is a certified music therapist; or
(3) practice music therapy;
unless the individual holds and maintains the credentialing administered by the Certification Board for Music Therapists.
Sec. 3. An individual who recklessly, knowingly, or intentionally violates section 2 of this chapter commits a Class B misdemeanor.
ARTICLE 23.9. MUSIC THERAPISTS
Chapter 1. Definitions
