1 | AN ACT concerning regulation.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Illinois Physical Therapy Act is amended by | |||||||||||||||||||
5 | adding Section 8.7 as follows:

6 | (225 ILCS 90/8.7 new) | |||||||||||||||||||
7 | Sec. 8.7. Criminal history records background check. Each
| |||||||||||||||||||
8 | applicant for licensure under Sections 8 and 8.1 shall have | |||||||||||||||||||
9 | his
or her fingerprints submitted to the Illinois State Police | |||||||||||||||||||
10 | in
an electronic format that complies with the form and manner | |||||||||||||||||||
11 | for
requesting and furnishing criminal history record | |||||||||||||||||||
12 | information
as prescribed by the Illinois State Police. These | |||||||||||||||||||
13 | fingerprints
shall be transmitted through a live scan | |||||||||||||||||||
14 | fingerprint vendor
licensed by the Department. These | |||||||||||||||||||
15 | fingerprints shall be checked
against the Illinois State | |||||||||||||||||||
16 | Police and Federal Bureau of
Investigation criminal history | |||||||||||||||||||
17 | record databases now and
hereafter filed. The Illinois State | |||||||||||||||||||
18 | Police shall charge
applicants a fee for conducting the | |||||||||||||||||||
19 | criminal history records
check, which shall be deposited into | |||||||||||||||||||
20 | the State Police Services
Fund and shall not exceed the actual | |||||||||||||||||||
21 | cost of the records check.
The Illinois State Police shall | |||||||||||||||||||
22 | furnish, pursuant to positive
identification, records of | |||||||||||||||||||
23 | Illinois convictions to the
Department. The Department may |

1 | require applicants to pay a separate fingerprinting fee, | ||||||
2 | either to the Department or to a vendor designated or approved | ||||||
3 | by the Department. The Department, in its discretion, may | ||||||
4 | allow an applicant or licensee who does not have reasonable | ||||||
5 | access to a designated vendor to provide his or her | ||||||
6 | fingerprints in an alternative manner. The Department may | ||||||
7 | adopt any rules necessary to implement this Section.
