1 AN ACT concerning regulation.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Physical Therapy Act is amended by
5adding Section 8.7 as follows:
6 (225 ILCS 90/8.7 new)
7 Sec. 8.7. Criminal history records background check. Each
8applicant for licensure under Sections 8 and 8.1 shall have
9his or her fingerprints submitted to the Illinois State Police
10in an electronic format that complies with the form and manner
11for requesting and furnishing criminal history record
12information as prescribed by the Illinois State Police. These
13fingerprints shall be transmitted through a live scan
14fingerprint vendor licensed by the Department. These
15fingerprints shall be checked against the Illinois State
16Police and Federal Bureau of Investigation criminal history
17record databases now and hereafter filed. The Illinois State
18Police shall charge applicants a fee for conducting the
19criminal history records check, which shall be deposited into
20the State Police Services Fund and shall not exceed the actual
21cost of the records check. The Illinois State Police shall
22furnish, pursuant to positive identification, records of
23Illinois convictions to the Department. The Department may

1require applicants to pay a separate fingerprinting fee,
2either to the Department or to a vendor designated or approved
3by the Department. The Department, in its discretion, may
4allow an applicant or licensee who does not have reasonable
5access to a designated vendor to provide his or her
6fingerprints in an alternative manner. The Department may
7adopt any rules necessary to implement this Section.
