Bill Title: Amends the Public Utilities Act. Provides that a gas utility must waive or not assess any demand charges on non-residential customers with Rate GDS-5 seasonal gas delivery if the gas is used for agricultural grain drying purposes if, as determined by the United States Department of Agriculture National Agricultural Statistics Service by November 1 of that contract year, 35% or less of the corn crop in the State has been harvested. Effective immediately.

2 | Be it enacted by the People of the State of Illinois,

3 | represented in the General Assembly:

4 | Section 5. The Public Utilities Act is amended by adding | |||||||||||||||||||
5 | Section 9-220.3 as follows:

6 | (220 ILCS 5/9-220.3 new) | |||||||||||||||||||
7 | Sec. 9-220.3. Waiver of gas demand charges for grain drying | |||||||||||||||||||
8 | during harvest. A gas utility must waive or not assess any | |||||||||||||||||||
9 | demand charges on non-residential customers with Rate GDS-5 | |||||||||||||||||||
10 | seasonal gas delivery if the gas is used for agricultural grain | |||||||||||||||||||
11 | drying purposes if, as determined by the United States | |||||||||||||||||||
