SYNOPSIS AS INTRODUCED:
220 ILCS 5/9-220.3 new

Amends the Public Utilities Act. Provides that a gas utility must waive or not assess any demand charges on non-residential customers with Rate GDS-5 seasonal gas delivery if the gas is used for agricultural grain drying purposes if, as determined by the United States Department of Agriculture National Agricultural Statistics Service by November 1 of that contract year, 35% or less of the corn crop in the State has been harvested. Effective immediately.

1 AN ACT concerning utilities.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Public Utilities Act is amended by adding
5 Section 9-220.3 as follows:
6 (220 ILCS 5/9-220.3 new)
7 Sec. 9-220.3. Waiver of gas demand charges for grain drying
8 during harvest. A gas utility must waive or not assess any
9 demand charges on non-residential customers with Rate GDS-5
10 seasonal gas delivery if the gas is used for agricultural grain
11 drying purposes if, as determined by the United States
12 Department of Agriculture National Agricultural Statistics
13 Service by November 1 of that contract year, 35% or less of the
14 corn crop in the State has been harvested.
15 Section 99. Effective date. This Act takes effect upon
16 becoming law.
