Bill Title: Amends the Department of Transportation Law of the Civil Administrative Code of Illinois. Requires the Secretary of Transportation to establish and convene the Zero Traffic Fatalities Task Force to develop a structured, coordinated process for early engagement of all parties to develop policies to reduce traffic fatalities to zero. Provides that the Task Force shall include, but is not limited to, representatives from the Illinois State Police, State-supported institutions of higher learning, the Department of Transportation, the Department of Public Health, local governments, bicycle safety organizations, statewide motorist service membership organizations, transportation advocacy organizations, and labor organizations. Requires the Secretary of Transportation to prepare and submit a report of findings based on the Zero Traffic Fatalities Task Force's efforts to the General Assembly on or before January 1, 2025. Sets forth issues that shall be included in the report. Provides for repeal of the provisions on January 1, 2026. Effective immediately.

1 | AN ACT concerning transportation.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Department of Transportation Law of the
| ||||||
5 | Civil Administrative Code of Illinois is amended by adding | ||||||
6 | Section 2705-211 as follows:

7 | (20 ILCS 2705/2705-211 new) | ||||||
8 | Sec. 2705-211. Zero Traffic Fatalities Task Force. | ||||||
9 | (a) On or before July 1, 2024, the Secretary of | ||||||
10 | Transportation shall establish and convene the Zero Traffic | ||||||
11 | Fatalities Task Force to develop a structured, coordinated | ||||||
12 | process for early engagement of all parties to develop | ||||||
13 | policies to reduce traffic fatalities to zero. | ||||||
14 | (b) The Task Force shall include, but is not limited to, | ||||||
15 | representatives from the Illinois State Police, | ||||||
16 | State-supported institutions of higher learning, the | ||||||
17 | Department of Transportation, the Department of Public Health, | ||||||
18 | the Secretary of State, motorcycle safety organizations, local | ||||||
19 | governments, bicycle safety organizations, statewide motorist | ||||||
20 | service membership organizations, transportation advocacy | ||||||
21 | organizations, and labor organizations. | ||||||
22 | (c) The Secretary of Transportation shall prepare and | ||||||
23 | submit a report of findings based on the Zero Traffic |

1 | Fatalities Task Force's efforts to the General Assembly on or | ||||||
2 | before January 1, 2025.
The report shall include, but is not | ||||||
3 | limited to, a detailed analysis of the following issues: | ||||||
4 | (1) The existing process for establishing speed | ||||||
5 | limits, including a detailed discussion on where speed | ||||||
6 | limits are allowed to deviate from the 85th percentile. | ||||||
7 | (2) Existing policies on how to reduce speeds on local | ||||||
8 | streets and roads. | ||||||
9 | (3) A recommendation as to whether an alternative to | ||||||
10 | the use of the 85th percentile as a method for determining | ||||||
11 | speed limits should be considered, and if so, what | ||||||
12 | alternatives should be looked at. | ||||||
13 | (4) Engineering recommendations on how to increase | ||||||
14 | vehicular, pedestrian, and bicycle safety. | ||||||
15 | (5) Additional steps that can be taken to eliminate | ||||||
16 | vehicular, pedestrian, and bicycle fatalities on the road. | ||||||
17 | (6) Existing reports and analyses on calculating the | ||||||
18 | 85th percentile at the local, State, national, and | ||||||
19 | international levels. | ||||||
20 | (7) Usage of the 85th percentile in urban and rural | ||||||
21 | settings. | ||||||
22 | (8) How local bicycle and pedestrian plans affect the | ||||||
23 | 85th percentile. | ||||||
24 | (d) This Section is repealed on January 1, 2026.
