services

accept,
or
renew

any
waiver
of
work
requirements
for
supplemental
nutrition

assistance
program
benefits
as
established
under
7
U.S.C.
18
§2015(o).

Employment
and
training

assignment
in
food
assistance.

The
department
of
human
services
shall
assign
individuals
22
receiving
food
assistance
program
benefits
subject
to
23
requirements
established
under
7
U.S.C.
§2015(d)(1),
but
not
24
subject
to
requirements
established
under
7
U.S.C.
§2015(o),
25
to
an
employment
and
training
program
as
defined
in
7
U.S.C.
26
§2015(d)(4).

4.
NEW
SECTION
.
249A.3B
Work
requirements.
28
1.
Unless
exempt
pursuant
to
subsection
2,
an
individual
29
shall
not
be
eligible
for
Medicaid
unless
the
individual
30
meets
one
of
the
following
requirements,
as
determined
by
the
31
department:
32
a.
Is
working
twenty
hours
or
more
per
week,
averaged
33
monthly.

b.
Is
participating
in
and
complying
with
the
requirements

a
work
program
twenty
hours
or
more
per
week.

c.
Is
volunteering
twenty
hours
or
more
per
week.

d.
Is
meeting
any
combination
of
working

twenty
hours
or
more
per
week.

e.
Is
participating
and
complying
with
the
requirements
of
a
5
workfare
program.

2.
Subsection
1
shall
not
apply
to
an
individual
who
meets
7
any
of
the
following
conditions:
8
a.
Is
under
eighteen
years
of
age.
9
b.
Is
over
sixty-four
years
of
age.
10
c.
Is
medically
certified
as
physically
or
mentally
unfit
11
for
employment.
12
d.
Is
pregnant.
13
e.
Is
a
parent
or
caretaker
responsible
for
the
care
of
a
14
dependent
child
under
one
year
of
age.
15
f.
Is
a
parent
or
caretaker
personally
providing
the
care
16
for
a
dependent
child
with
a
serious
medical
condition
or
with
17
a
disability,
as
determined
by
the
department.
18
g.
Is
receiving
unemployment
compensation
and
complying
19
with
work
requirements
that
are
part
of
the
federal-state
20
unemployment
compensation
system.
21
h.
Is
participating
in
a
drug
addiction
or
alcoholic
22
treatment
and
rehabilitation
program.

Sec.
5.
ADMINISTRATION
PROVISIONS.
24
The
department
of
human
services
shall
do
all
of
the
25
following:
26
1.
Submit
any
state
plan
amendment
or
waiver
needed
to
27
implement
the
provisions
of
this
Act
no
later
than
January
1,
28
2021.
29
2.
Adopt
rules
pursuant
to
chapter
17A
as
necessary
to
30
administer
this
Act.
31
Sec.
6.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
32
importance,
takes
effect
upon
enactment.
33
Sec.
7.
IMPLEMENTATION.
Implementation
of
the
provisions
34
of
this
Act
shall
be
in
accordance
with
the
following:

If
a
provision
does
not
require
federal
approval,
the
1
provision
shall
be
implemented
beginning
January
1,
2021.

2.
If
a
provision
requires
federal
approval,
the
provision
3
shall
only
be
implemented
upon
receipt
by
the
department
of
4
human
services
of
such
federal
approval.

EXPLANATION
6
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
7
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
eligibility,
training,
and
work
9
requirements
for
public
assistance
programs.
10
With
regard
to
the
food
assistance
program,
the
bill
11
prohibits
DHS
from
granting
categorical
eligibility
for
any
12
noncash,
in-kind,
or
other
benefit
unless
expressly
required
by
13
federal
law
for
the
supplemental
nutrition
assistance
program;
14
and
prohibits
DHS
from
applying
gross
income
standards
for
the
15
food
assistance
program
that
are
higher
than
the
standards
16
specified
in
federal
law
unless
expressly
required
by
federal
17
law.
Categorical
eligibility
exempting
households
from
such
18
gross
income
standards
requirements
shall
not
be
granted
for
19
any
noncash,
in-kind,
or
other
benefit,
unless
expressly
20
required
by
federal
law.
21
The
bill
also
provides
that
unless
expressly
required
by
22
federal
law,
DHS
shall
not
seek,
apply
for,
accept,
or
renew
23
any
waiver
of
work
requirements
for
supplemental
nutrition
24
assistance
program
benefits
as
established
under
federal
law.
25
DHS
is
required
to
assign
individuals
receiving
food
assistance
26
program
benefits
subject
to
requirements
established
under
27
federal
law
who
are
not
otherwise
exempt
under
federal
law
to
28
an
employment
and
training
program.
29
With
regard
to
the
Medicaid
program,
the
bill
prohibits
a
30
person
from
being
eligible
for
Medicaid
unless
the
individual
31
meets
one
of
the
work-related
requirements
specified
in
the
32
bill.
The
bill
specifies
those
individuals
exempt
from
the
33
work-related
requirements.

The
bill
requires
DHS
to
submit
any
state
plan
amendment
or

necessary
to
implement
the
bill
no
later
than
January
1
1,
2021,
and
to
adopt
administrative
rules
as
necessary
to

administer
the
bill.

The
bill
takes
effect
upon
enactment.
The
provisions
of
the
4
bill
that
do
not
require
federal
approval
shall
be
implemented
5
beginning
January
1,
2021;
and
those
that
require
federal
6
approval
shall
only
be
implemented
upon
receipt
by
DHS
of
such
7
federal
approval.
