S.F. _____ Section 1. NEW SECTION . 279.76 Parent or guardian bill of 1 rights. 2 1. All of the following parental rights are reserved to 3 the parent or guardian of a minor child without obstruction or 4 interference from the board of directors of the school district 5 in which the minor child is enrolled: 6 a. The right to know what the board of directors of the 7 school district in which the minor child is enrolled is 8 teaching the minor child, including the textbooks, books, 9 articles, outlines, handouts, presentations, videos, and any 10 other similar materials the board of directors of the school 11 district uses for student instruction. 12 b. The right to access and review information related to 13 who is teaching the minor child, including guest lecturers and 14 outside presenters. 15 c. The right to access and review information related to 16 persons who contract with or otherwise receive moneys from the 17 board of directors of the school district. 18 d. The right to reasonable access to the minor child while 19 the minor child is in school to ensure the minor child’s health 20 and safety, unless otherwise prohibited by law. 21 e. The right to access and review all school records 22 relating to the minor child. 23 f. The right to access and review information related to the 24 collection and transmission of information related to the minor 25 child, including assessment information, documents created by 26 the minor child, and teacher evaluations of the minor child. 27 g. Subject to section 22.7, the right to access and 28 review information necessary to ensure the accountability and 29 transparency of the board of directors of the school district 30 in which the minor child is enrolled. 31 h. The right to access and review information related to the 32 minor child’s safety while at school. 33 2. a. The board of directors of a school district shall 34 not require any student to engage in any activity, including 35 -1- LSB 5486XC (3) 89 jda/jh 1/ 3
S.F. _____ instruction, or any test, assessment, or other means of 1 evaluation, that involves obscene material without the express 2 prior written consent of the student’s parent or guardian. 3 b. The board of directors of a school district shall not 4 allow a minor child to access obscene material in a classroom 5 or to check out obscene material from a library operated by the 6 board of directors of the school district without the express 7 prior written consent of the minor child’s parent or guardian. 8 c. For purposes of this subsection, “obscene material” means 9 the same as defined in section 728.1. 10 3. The rights guaranteed to parents and guardians by this 11 section are not a comprehensive list of the rights reserved 12 to parents or guardians of a minor child. The enumeration of 13 the rights contained in this section shall not be construed to 14 limit the rights reserved to parents or guardians of a minor 15 child. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill relates to the rights of parents and guardians of 20 students enrolled in school districts. 21 The bill creates new Code section 279.76 (parent or guardian 22 bill of rights). The bill provides that, notwithstanding any 23 provision of law to the contrary, the following rights are 24 reserved to the parent or guardian of a minor child: the right 25 to know what the board of directors of the school district 26 in which the minor child is enrolled is teaching the minor 27 child, the right to access and review information related to 28 who is teaching the minor child, the right to access and review 29 information related to persons who contract with or otherwise 30 receive moneys from the board of directors of the school 31 district, the right to reasonable access to the minor child 32 while the minor child is in school to ensure the minor child’s 33 health and safety, unless otherwise prohibited by law, the 34 right to access and review all school records relating to the 35 -2- LSB 5486XC (3) 89 jda/jh 2/ 3
S.F. _____ minor child, the right to access and review information related 1 to the collection and transmission of information related to 2 the minor child, the right to access and review information 3 necessary to ensure the accountability and transparency of 4 the board of directors of the school district, and the right 5 to access and review information related to the minor child’s 6 safety at school. 7 The bill provides that the board of directors of a school 8 district shall not require any student to engage in any 9 activity, including instruction or any test, assessment, or 10 other means of evaluation that involves obscene material 11 without the express prior written consent of the student’s 12 parent or guardian. The bill also provides that the board of 13 directors of a school district shall not allow a minor child to 14 access obscene material in a classroom or to check out obscene 15 material from a library without the express prior written 16 consent of the minor child’s parent or guardian.
