Section
1.
Section
312.2,
subsection
12,
paragraph
a,
Code
1
2022,
is
amended
to
read
as
follows:
2
a.
(1)
The
treasurer
of
state,
before
making
the
3
allotments
provided
for
in
this
section
,
for
the
fiscal
year
4
beginning
July
1,
1990,
and
each
succeeding
fiscal
year,
shall
5
credit
from
the
road
use
tax
fund
two
million
dollars
to
the
6
county
bridge
construction
fund,
which
is
hereby
created.
7
Moneys
credited
to
the
county
bridge
construction
fund
8
shall
be
allocated
to
counties
by
the
department
for
bridge
9
construction,
reconstruction,
replacement,
or
realignment
based
10
on
needs
in
accordance
with
rules
adopted
by
the
department.

(2)
The
department
shall
allocate
moneys
deposited
in
the
12
fund
under
section
321E.14,
subsection
1,
paragraph
“0j”
,
only
13
to
counties
having
jurisdiction
over
secondary
roads
on
which
14
vehicles
issued
a
permit
pursuant
to
section
321E.8,
subsection
15
1A,
are
authorized
to
operate.
Such
counties
may
submit
an
16
application
to
the
department
for
moneys
from
the
fund
for
two
17
additional
bridge
candidates
per
year.

Sec.
2.
Section
321E.2,
subsections
1
and
4,
Code
2022,
are
19
amended
to
read
as
follows:

1.
The
department
and
local
authorities
may
in
their
21
discretion
and
upon
application
and
with
good
cause
shown
22
issue
permits
for
the
movement
of
special
mobile
equipment
23
being
temporarily
moved
on
streets,
roads,
or
highways
and
24
for
vehicles
with
indivisible
loads
,
or
divisible
loads
where
25
expressly
authorized
under
this
chapter,
which
exceed
the
26
maximum
dimensions
and
weights
specified
in
sections
321.452
27
through
321.466
,
but
not
to
exceed
the
limitations
imposed
in
28
this
section
and
sections
321E.3
through
321E.15
except
as
29
provided
in
section
321E.29
.

When
in
the
judgment
of
the
permit-issuing
authority
the

movement
of
a
vehicle
with
an
indivisible
or
divisible
load
or

special
mobile
equipment
which
exceeds
the
maximum
dimensions

and
weights
will
be
unduly
hazardous
to
public
safety
or
will

cause
undue
damage
to
infrastructure
or
other
public
or
private

the
permit
shall
be
denied
and
the
reasons
for
denial

endorsed
on
the
application.
Permits
shall
designate
the
days
2
when
and
routes
upon
which
loads
and
special
mobile
equipment
3
may
be
moved
within
a
county
on
other
than
primary
roads.

Sec.
3.
Section
321E.3,
subsection
1,
Code
2022,
is
amended
5
to
read
as
follows:

1.
a.
Permits
issued
under
this
chapter
shall
be
issued
7
by
the
authority
responsible
for
the
maintenance
of
the
system
8
of
highways
or
streets.
However,
the
department
may
issue
9
permits
on
primary
road
extensions
in
cities
in
conjunction
10
with
movements
on
the
rural
primary
road
system.
11
b.
The
department
may
issue
an
all-systems
permit
permits
12
under
section
321E.8
which
is
are
valid
for
movements
on
13
all
highways
or
streets
under
the
jurisdiction
of
either
14
the
state
,
except
the
interstate
road
system
if
prohibited
15
under
section
321E.8,
or
those
local
authorities
that
have
16
indicated
to
the
department
in
writing,
including
by
means
of
17
electronic
communication,
those
streets
or
highways
for
which
18
an
all-systems
permit
is
not
valid.

Sec.
4.
Section
321E.8,
Code
2022,
is
amended
by
adding
the
20
following
new
subsection:

NEW
SUBSECTION
.
1A.
Vehicles
with
indivisible
or
22
divisible
loads
having
an
overall
width
not
to
exceed
the
width
23
authorized
under
section
321.454,
an
overall
length
not
to
24
exceed
the
length
authorized
under
section
321.457,
an
overall
25
height
not
to
exceed
the
height
authorized
under
section
26
321.456,
and
a
total
gross
weight
not
to
exceed
the
gross
27
weight
authorized
under
section
321.463
by
more
than
twelve
28
percent,
may
operate
under
an
all-systems
permit
and
shall
29
obtain
route
approval
from
the
department.
Permitted
vehicles
30
under
this
subsection
with
a
gross
weight
exceeding
eighty
31
thousand
pounds
shall
not
be
allowed
to
travel
on
any
portion
32
of
the
interstate
road
system.

permit

Seventy-five
percent
of
the
fee
shall
be

deposited
in
the
county
bridge
construction
fund
created
in

section
312.2,
subsection
12,
and
twenty-five
percent
of
the
10
fee
shall
be
deposited
in
the
road
use
tax
fund.

Sec.
7.
EFFECTIVE
DATE.
This
Act
takes
effect
January
1,
12
2023.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
15
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
Code
section
321.463
limits
the
gross
17
weight
of
a
vehicle
based
on
the
highway
of
travel
and
the
18
number
of
axles
and
the
distance
between
the
axles
on
the
19
vehicle.
Generally,
vehicles
are
allowed
to
have
a
maximum
20
gross
weight
of
up
to
80,000
pounds
on
any
highway,
and
21
commercial
motor
vehicles
with
six
or
seven
axles
are
allowed
22
to
have
a
gross
weight
of
up
to
96,000
pounds
on
noninterstate
23
highways.
To
operate
in
excess
of
the
gross
weights
allowed
24
under
Code
section
321.463,
Code
chapter
321E
authorizes
25
single-trip,
multi-trip,
and
annual
permits
for
vehicles
of
26
excessive
size
and
weight.
Generally,
such
permits
may
be
27
issued
by
the
department
of
transportation
(DOT)
for
vehicles
28
traveling
on
primary
highways,
primary
road
extensions
in
29
cities
in
conjunction
with
movements
on
the
rural
primary
road
30
system,
and
secondary
roads
or
city
streets
at
the
request
of
a
31
local
authority.
A
local
authority
may
also
generally
issue
32
such
permits
for
streets
or
highways
under
its
jurisdiction.

The
DOT
may
issue
an
annual
all-systems
permit
authorizing
34
vehicles
of
excessive
size
and
weight,
not
to
exceed
80,000

pounds,
to
travel
on
state
highways
and
those
streets
or
1
highways
of
local
authorities
that
have
indicated
to
the
DOT
2
the
streets
or
highways
for
which
an
all-systems
permit
is
not
3
valid.
The
fee
for
an
annual
all-systems
permit
is
$160.

This
bill
authorizes
the
DOT
to
issue
an
annual
all-systems
5
permit
for
vehicles
carrying
an
indivisible
or
divisible
load
6
not
exceeding
the
current
size
restrictions
under
Code
chapter
7
321
and
not
exceeding
the
gross
weight
authorized
under
Code
8
section
321.463
by
more
than
12
percent.
Vehicles
permitted
9
under
the
bill
with
a
gross
weight
exceeding
80,000
pounds
are
10
prohibited
from
traveling
on
any
portion
of
the
interstate
road
11
system.
12
The
fee
for
the
permit
is
$500.
Of
the
fee,
$375
must
be
13
deposited
into
the
county
bridge
construction
fund
and
$125
14
must
be
deposited
in
the
road
use
tax
fund.
Only
counties
with
15
jurisdiction
over
secondary
roads
on
which
vehicles
with
a
16
permit
issued
pursuant
to
the
bill
are
authorized
to
operate
17
are
eligible
to
receive
the
county
bridge
construction
fund
18
moneys
generated
by
the
fee.
Such
counties
may
submit
an
19
application
to
the
DOT
for
funding
for
two
additional
bridge
20
candidates
each
year.
21
The
bill
takes
effect
January
1,
2023.
