  1  1    Section 1.  NEW SECTION.  321.492C  Use of automated or remote
  1  2 systems for traffic law enforcement prohibited.
  1  3    The state or a political subdivision of the state shall not
  1  4 place or cause to be placed on or adjacent to a highway, or
  1  5 maintain or employ the use of, any automated or remote system
  1  6 for traffic law enforcement. For the purposes of this section,
  1  7 "automated or remote system for traffic law enforcement" means a
  1  8 camera or other optical device designed to work in conjunction
  1  9 with an official traffic control signal or speed detection
  1 10 equipment to identify motor vehicles operating in violation of
  1 11 traffic laws, the use of which results in the issuance of civil
  1 12 infractions sent through the mail or by electronic means.
  1 13    Sec. 2.  REMOVAL OF AUTOMATED OR REMOTE SYSTEMS FOR TRAFFIC
  1 14 LAW ENFORCEMENT ==== VALIDITY OF PRIOR NOTICES AND CITATIONS.  On
  1 15 or before July 1, 2017, a local authority using an automated
  1 16 or remote system for traffic law enforcement shall discontinue
  1 17 using the system and remove the system equipment. Effective
  1 18 July 1, 2017, all local ordinances authorizing the use of
  1 19 automated or remote systems for traffic law enforcement are
  1 20 void. However, any notice of violation mailed or any citation
  1 21 issued pursuant to such an ordinance prior to July 1, 2017,
  1 22 shall not be invalidated by the enactment of this Act and shall
  1 23 be processed according to the provisions of the law under which
  1 24 it was authorized.
  1 25    Sec. 3.  EFFECTIVE UPON ENACTMENT.  The section of this Act
  1 26 relating to the removal of automated or remote systems for
  1 27 traffic law enforcement and the validity of prior notices and
  1 28 citations, being deemed of immediate importance, takes effect
  1 29 upon enactment.
  1 30                           EXPLANATION
  1 31 The inclusion of this explanation does not constitute agreement with
  1 32 the explanation's substance by the members of the general assembly.
  1 33    This bill imposes a statewide prohibition on the placement
  1 34 and use of automated or remote systems for traffic law
  1 35 enforcement. The bill defines "automated or remote system for
  2  1 traffic law enforcement" to mean a camera or other optical
  2  2 device designed to work in conjunction with an official traffic
  2  3 control signal or speed detection equipment to identify motor
  2  4 vehicles operating in violation of traffic laws, the use of
  2  5 which results in the issuance of civil infractions sent through
  2  6 the mail or by electronic means. This provision of the bill
  2  7 takes effect July 1, 2017.
  2  8    Local authorities that are currently using automated or
  2  9 remote systems for traffic law enforcement must discontinue
  2 10 their use and remove related equipment on or before July 1,
  2 11 2017. On that date, all local ordinances authorizing the use
  2 12 of automated or remote systems for traffic law enforcement
  2 13 are void. However, notices of violations mailed or citations
  2 14 issued prior to July 1, 2017, are not invalidated by the bill
  2 15 and remain enforceable. These provisions of the bill take
  2 16 effect upon enactment.
