1.
NEW
SECTION
.
123.35
Toilet
facilities.
1
The
division
shall
not
deny
an
application
for
a
license
2
or
permit
to
sell
alcoholic
beverages
for
consumption
on
the
3
premises
on
the
grounds
that
the
licensee
or
permittee
does
not
4
provide
more
than
one
toilet
facility
for
patrons.

Sec.
2.
Section
137F.2,
Code
2021,
is
amended
by
adding
the
6
following
new
subsection:

NEW
SUBSECTION
.
3.
In
establishing
minimum
standards
as
8
described
in
subsection
1,
the
department
shall
not
require
a
9
food
establishment
that
serves
alcoholic
beverages,
as
defined
10
in
section
123.3,
to
provide
more
than
one
toilet
facility
11
available
to
patrons.

EXPLANATION
13
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
14
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
prohibits
the
alcoholic
beverages
division
16
from
denying
an
application
for
a
license
or
permit
to
sell
17
alcoholic
beverages
for
consumption
on
the
premises
on
the
18
grounds
that
the
licensee
or
permittee
does
not
provide
more
19
than
one
toilet
facility
for
patrons.
20
The
bill
prohibits
the
department
of
inspections
21
and
appeals,
when
adopting
minimum
standards
for
food
22
establishments,
from
requiring
a
food
establishment
that
serves
23
alcoholic
beverages
to
provide
more
than
one
toilet
facility

available
to
patrons.
