SENATE CONCURRENT

RESOLUTION

 

 

URGING a REVISion to PRESENT POLICIES ON MATTERS OF BLOOD QUANTUM FOR SUCCESSORs to lessees of a hawaiian home lands lease.

 

 


     WHEREAS, currently, the Hawaiian Homes Commission Act, 1920, requires that upon the death of a homestead lessee, the lessee's interest shall vest in the relatives of the decedent who are at least one-quarter Hawaiian; and

 

     WHEREAS, the requirement that a successor to a lease has at least one-quarter or twenty-five percent blood quantum imposes a significant hardship on those lessees who are unable to assure transfer of lessee rights to a relative of less than one-quarter Hawaiian blood; and

 

     WHEREAS, a significant number of marriages occur between qualified lessees and non-qualified spouses, directly affecting generations of Hawaiians by reducing the blood quantum, in some families, numerous times during a lessee's lifetime; and

 

     WHEREAS, a reduction in the required blood quantum for a successor is long overdue, particularly for those lessees faced with reserving the transfer of their award to their eligible successor; now, therefore,

 

     BE IT RESOLVED by the Senate of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2011, the House of Representatives concurring, that the Department of Hawaiian Home Lands is urged to revise its present policies on matters of blood quantum for successors to homestead lessees; and

 

     BE IT FURTHER RESOLVED that the Department of Hawaiian Home Lands' policy to allow a lessee's interest in a homestead lease to vest to a successor that is based upon a minimum percentage of Hawaiian blood quantum be reduced from requiring the successor to have a minimum blood quantum of twenty-five percent to merely requiring the successor to have a minimum blood quantum of no more than 12.5 percent in order for the successor to qualify as an eligible successor and vest in the interest of a lessee's homestead lease; and

 

     BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Chairperson of the Hawaiian Homes Commission.
