A BILL FOR AN ACT

 

 

RELATING TO SCHOOL PSYCHOLOGY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to establish a working group to assess and make recommendations on the most appropriate regulatory framework and licensure requirements for school psychologists in the State.

     SECTION 2.  (a)  There is established a working group within the Department of Education for administrative purposes only.  The working group shall research and explore the idea of establishing a regulatory framework and licensure requirements for school psychologists in the State.

     (b)  The working group shall address and make recommendations on:

     (1)  The appropriate regulatory framework for school psychologists in the State, including the most appropriate board or agency to administer, implement, and enforce the regulation;

     (2)  The appropriate licensing criteria for school psychologists in the State, including but not limited to the work or type of work the individuals will need to complete to be licensed;

     (3)  Concerns raised by the office of the auditor in Report No. 22-13, issued in November 2022, including but not limited to the appropriate definition of the practice of school psychology that should be subject to the regulation; and

     (4)  Any other issues that may arise, pursuant to the discretion of the working group.

     (c)  The working group shall consist of the following

members:

     (1)  The superintendent of education, or the superintendent's assignee, who shall serve as chairperson of the working group;

     (2)  The administrator of the professional and vocational licensing division of the department of commerce and consumer affairs, or the administrator's assignee;

     (3)  One member of the board of psychology; and

     (4)  One member of the Hawaii Association of School Psychologists, to be invited by the chairperson of the working group.

     (d)  The working group shall report its findings and recommendations, including any proposed legislation, to the legislature no later than twenty days prior to the convening of the regular session of 2025.

     (e)  The members of the working group shall serve without compensation but shall be reimbursed for expenses, including travel expenses, necessary for the performance of their duties.

     (f)  No member of the working group shall be subject to chapter 84, Hawaii Revised Statutes, solely because of the member's participation in the working group.

     SECTION 3.  This Act shall take effect on December 31, 2050.
