A BILL FOR AN ACT

 

 

relating to health care practitioners.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:

"Chapter

health care practitioner education disclosure requirements

     §   -1  Definitions.  As used in this chapter:

     "Health care practitioner" or "practitioner" means:  acupuncture practitioners licensed pursuant to chapter 436E; chiropractors licensed pursuant to chapter 442; dental hygienists licensed pursuant to chapter 447; dentists licensed pursuant to chapter 448; licensed dietitians licensed pursuant to chapter 448B; massage therapists licensed pursuant to chapter 452; physicians and osteopathic physicians licensed pursuant to chapter 453; physician assistants licensed pursuant to chapter 453; naturopathic physicians licensed pursuant to chapter 455; nurses licensed pursuant to chapter 457; occupational therapists licensed pursuant to chapter 457G; optometrists licensed pursuant to chapter 459; pharmacists licensed pursuant to chapter 461; physical therapists licensed pursuant to chapter 461J; podiatrists licensed pursuant to chapter 463E; psychologists licensed pursuant to chapter 465; social workers licensed pursuant to chapter 467E; and speech pathologists and audiologists licensed pursuant to chapter 468E.

     "Licensing authority" shall have the same meaning as in section 436B-2.

     §   -2  Disclosure; license type; highest level of academic degree; website.  (a)  A health care practitioner shall communicate the health care practitioner's name, license type, and highest level of academic degree to a patient in the following manner:

     (1)  In writing during the patient's initial office visit; or

     (2)  Through a prominent display in an area visible to patients in the health care practitioner's office.

     (b)  In addition to the requirements under subsection (a), a health care practitioner who is licensed as a physician or osteopathic physician under chapter 453 and is certified by:

     (1)  An American Board of Medical Specialties member board;

     (2)  A board or association with requirements equivalent to a board under paragraph (1) that has been approved by the practitioner's licensing authority; or

     (3)  A board or association with an Accreditation Council for Graduate Medical Education-approved postgraduate training program that provides complete training in the practitioner's specialty or subspecialty;

shall also disclose the name of the board or association by one or both methods described in subsection (a)(1) and (2).

     (c)  A health care practitioner who is licensed under chapter 457 or 461 is required to communicate the information required under subsection (a) except the highest level of academic degree that the practitioner holds.

     (d)  A health care practitioner who discloses the information required by subsections (a) and (b) shall present the information, in at least twenty-four-point type, in the following format:

          "HEALTH CARE PRACTITIONER INFORMATION

      1.  (Insert health care practitioner name and license)

      2.  (Insert health care practitioner's highest level of academic degree)

      3.  (Insert health care practitioner's board certification, where applicable)".

     (e)  A health care practitioner who provides information regarding health care services on an internet website that is directly controlled or administered by the health care practitioner or the practitioner's office personnel shall prominently display the information required by subsections (a) and (b) on the website.

     §   -3  Exemptions.  This chapter shall not apply to:

     (1)  A person who works for a skilled nursing facility, intermediate care facility, adult residential care home, adult foster home, assisted living facility, or hospice regulated by the department of health pursuant to section 321-11(10);

     (2)  A person licensed in a clinical laboratory occupation under section 321-13;

     (3)  Licensed marriage and family therapists licensed pursuant to chapter 451J;

     (4)  Licensed mental health counselors licensed pursuant to chapter 453D;

     (5)  Respiratory therapists licensed pursuant to chapter 466D; and

     (6)  Veterinarians licensed pursuant to chapter 471."

     SECTION 2.  This Act shall take effect upon its approval.
