A BILL FOR AN ACT

 

 

RELATING TO FISH.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 147, part I, Hawaii Revised Statutes, is amended as follows:

     1.  By adding a new section to be appropriately designated and to read:

     "§147‑    Carbon monoxide- or gas-treated raw fish; sales prohibited.  (a)  No person shall sell raw fish that has been treated with carbon monoxide or other gas to preserve the color or texture of the raw fish to give the appearance of freshness.

     (b)  Notwithstanding section 147-2, any person who violates this section shall be subject to an administrative penalty of $1,000 for each offense.  Each sale of raw fish in violation of this section shall constitute a separate offense.  Any action taken to impose or collect the penalty shall be considered a civil action."

     2.  By amending its title to read:

"PART I.  FRESH FRUITS, VEGETABLES, NUTS, HONEY, [and] COFFEE, AND RAW FISH"

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2011.
