A BILL FOR AN ACT

 

 

RELATING TO HAWAIIAN LANGUAGE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


PART I

     SECTION 1.  The legislature finds that article X, section 4, of the Hawai`i State Constitution provides, in pertinent part, "The State shall promote the study of Hawaiian culture, history and language".  In addition, article XV, section 4, of the Hawai`i State Constitution establishes Hawaiian as one of two official languages of the State of Hawai`i.

     The purpose of this part is to appropriate funds to the University of Hawai`i to translate the Hawai`i State Constitution into the Hawaiian language.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $        or so much thereof as may be necessary for fiscal year 2018-2019 to translate the Hawai`i State Constitution into the Hawaiian language.

     The sum appropriated shall be expended by the University of Hawai`i for the purposes of this part.

PART II

     SECTION 3.  Chapter 601, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§601-     Hawaiian language; interpreter services.  Notwithstanding any other law to the contrary, a court, to the extent reasonably possible, shall provide interpreter services if any party to a proceeding requests that the proceeding be conducted in the Hawaiian language."

     SECTION 4.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2018-2019 to establish one full-time equivalent (1.0 FTE) position for the judiciary to provide interpreter services in the Hawaiian language in accordance with this part.  The position shall be exempt from the requirements of chapter 76, Hawaii Revised Statutes.

     The sum appropriated shall be expended by the judiciary for the purposes of this part.

PART III

     SECTION 5.  New statutory material is underscored.

     SECTION 6.  This Act shall take effect on July 1, 2018.

UH; Hawaiian Language Translation of State Constitution; Court Proceedings; Hawaiian Language Interpreters; Appropriation

 

Description:

Appropriates funds to the University of Hawai`i to translate the Hawai`i State Constitution into the Hawaiian language.  Requires courts, to the extent reasonably possible, to provide Hawaiian language translation services upon request of any party to a proceeding and appropriates funds to the Judiciary for this purpose.  (SD1)
