A BILL FOR AN ACT

 

 

RELATING TO INSURANCE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  (a)  The insurance commissioner shall establish and convene a working group for the purpose of evaluating the issue of balance billing in the State.

     (b)  The following individuals or their designees shall serve as members of the working group:

(1)  The insurance commissioner;

(2)  The chairperson of the committee on consumer protection and commerce of the house of representatives;

(3)  The chairperson of the committee on health of the house of representatives;

(4)  A representative from the department of health emergency medical services division;

(5)  A representative from the department of the attorney general;

(6)  A representative from the Hawaii Medical Service Association;

(7)  A representative from the American Congress of Obstetricians and Gynecologists;

(8)  A representative from the Hawaii Chapter American College of Emergency Physicians;

(9)  A representative from the Healthcare Association of Hawaii;

(10)  A representative from the Hawaii Coalition for Health;

(11)  A representative from United Health Alliance;

(12)  A representative from Hawaii Medical Association;

(13)  A representative from Kaiser Permanente; and

(14)  A representative from the air ambulance industry in Hawaii, to be selected by the insurance commissioner.

The insurance commissioner shall serve as the chairperson of the working group.

     (c)  The working group shall examine the following:

     (1)  The extent of balance billing in the State;

     (2)  Any data concerning and specific cases of balance billing in the State;

     (3)  State and national efforts related to mitigating balance billing; and

     (4)  Whether and to what extent an appropriate amount can or should be established for billings for services performed by a nonparticipating healthcare provider to a patient without prior or subsequent authorization from the patient's health care plan, including the amount that should be paid by an insurer to the nonparticipating healthcare provider.

     (d)  The working group shall submit a report of its findings and recommendations to the legislature no later than twenty days prior to the convening of the regular session of 2017, including an explanation of the methodologies used to reach its conclusions.

     (e)  The working group shall cease to exist on June 30, 2017.

     SECTION 2.  This Act shall take effect on July 1, 2112.
