A BILL FOR AN ACT

 

 

RELATING TO DevelopmenT.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the inmate population at Halawa correctional facility has reached its maximum capacity and that there needs to be additional incarceration space developed at Halawa correctional facility to alleviate overcrowding, eliminate the transfer of Hawaii inmates to jurisdictions outside of the State, and reduce the long-term costs of incarcerating people in this State.

     The legislature also finds that a portion of the planned route of the mass transit rail system is to travel on Dillingham Boulevard across from Oahu community correctional center and include a fixed guideway station nearby in Kalihi.  The legislature further finds that development of the Kalihi station transit-oriented development zone would enable the residents of Kalihi and the users of the mass transit rail system to enjoy better services and amenities as well as an improved quality of life.

     The purpose of this Act is to utilize a public-private partnership to develop additional incarceration space on state land at Halawa correctional facility in exchange for a long-term lease to develop the transit-oriented development zone near Oahu community correctional center.

     SECTION 2.  (a)  The director of public safety, in collaboration with the department of planning and permitting of the city and county of Honolulu, is directed to create a proposed plan for a public-private partnership to develop:

     (1)  Additional incarceration space at the Halawa correctional facility; and

     (2)  Facilities in the transit-oriented development zone near Oahu community correctional center. 

     The development proposal shall call for a public-private partnership with a qualified private entity.  The private entity shall agree to develop additional incarceration space at the Halawa correctional facility at no cost to the State, in exchange for a long-term lease and development rights to other state land located in the transit-oriented development zone near Oahu community correctional center.

     (b)  For purposes of this section, "transit-oriented development zone" means the parcels of land around a rapid transit station that is subject to transit-oriented development regulations of the county.

     SECTION 3.  The director of public safety shall report findings and recommendations to the legislature, no later than twenty days prior to the convening of the regular session of 2013, on the proposed plan described under section 2 of this Act.

     SECTION 4.  This Act shall take effect upon its approval.
