A BILL FOR AN ACT

 

 

RELATING TO RENEWABLE FUELS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the intent of the ten per cent ethanol requirement under section 486J-10, Hawaii Revised Statutes, is to provide energy independence from foreign oil, reduce statewide gasoline consumption, and establish industrial plants to produce ethanol locally.

     Hawaii imports all of its ethanol, along with crude oil, from overseas.  Act 257, Session Laws of Hawaii 1997, requires that gasoline sold in the State contain ten per cent ethanol.  Despite several planned ethanol plants and an abundance of vacant sugar cane land, no plants have been built.

     The legislature finds that the intent of Act 257 remains unfulfilled.  The legislature further finds that different requirements for diesel fuel may be necessary, as gasoline with ethanol or other biofuels is not an equal substitute for biodiesel because of mechanical and warranty issues involved with diesel engines.

     The purpose of this Act is to create a task force within the department of business, economic development, and tourism to perform a feasibility study and propose legislation for increasing locally-produced renewable fuel usage in the State.

     SECTION 2.  (a)  There shall be established within the department of business, economic development, and tourism a task force on renewable fuels.  The task force shall examine:

     (1)  Potential changes to the existing law requiring ten per cent ethanol fuel content in gasoline to a requirement that each distributor who sells liquid fuels in the State for use in motor vehicles shall ensure that locally produced renewable fuels account for at least ten per cent of the distributor's annual sales of fuels for motor vehicles;

     (2)  Requiring the mixture of up to five per cent of locally produced biofuels in diesel fuel; and

     (3)  Locally produced renewable fuels that are liquid or gaseous fuels that meet the relevant ASTM International specifications of the latest issue produced from renewable feedstock, including but not limited to biomass crops; agricultural residues; oil crops, including algae, canola, jatropha, palm, soybean, and sunflower; other agricultural crops; grease and waste cooking oil; food wastes; municipal solid wastes and industrial wastes; water; and animal residues and wastes.

     (b)  The task force shall be composed of:

     (1)  A member to be selected by the senate president;

     (2)  A member to be selected by the speaker of the house of representatives;

     (3)  A member to be selected by the director of business, economic development, and tourism;

     (4)  Representatives from the following organizations who shall be requested to serve on the task force:

         (A)  The Western States Petroleum Association;

         (B)  The Hawaii Automobile Dealers Association;

         (C)  The Alliance of Automobile Manufacturers; and

         (D)  The Airlines Committee of Hawaii; and

     (5)  Up to four representatives of renewable fuels producers in Hawaii who shall be requested by the director of business, economic development, and tourism to serve on the task force; provided that no more than two of the representatives shall represent biofuel producers; and provided further that the renewable fuels producers shall currently be operating in Hawaii or projected to be operating in Hawaii by December 31, 2015.

     (c)  The members of the task force shall serve without compensation, but shall be reimbursed for expenses necessary in the performance of their duties.

     (d)  The members of the task force shall select a chairperson from among themselves.

     (e)  The task force shall submit to the legislature a preliminary report of its activities, findings, and any recommendations for proposed legislation no later than twenty days prior to the convening of the regular session of 2015 and a final report of its activities, findings, and recommendations for proposed legislation no later than twenty days prior to the convening of the regular session of 2016.

     (f)  The task force shall cease to exist on August 1, 2016.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $         or so much thereof as may be necessary for fiscal year 2014-2015 to support the work of the task force on renewable fuels, including consulting and research costs.

     The sum appropriated shall be expended by the department of business, economic development, and tourism for the purposes of this Act.

     SECTION 4.  This Act shall take effect on July 1, 2050.
