A BILL FOR AN ACT
RELATING TO INFORMATION TECHNOLOGY PROJECTS.
BE IT
ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION
1. The legislature finds that modernization
of the State's information technology (IT) program is critical to providing effective
services to residents, running government efficiently, and rebooting and
upgrading the economy. The recent coronavirus
disease 2019 pandemic has highlighted the extraordinary negative societal
impact of having key state programs that rely on outdated technology and the
tremendous benefits of modern IT infrastructure.
The
legislature further finds that multiple crucial state IT modernization programs
are currently in progress, including replacement of IT systems for unemployment
insurance, disability compensation, financial management, child and family welfare,
behavioral health, and state employee benefits.
The
legislature additionally finds that independent verification and validation reports
on state modernization projects consistently note that these projects are at risk
because the State does not dedicate enough personnel to ongoing modernization projects.
This results in an over-reliance on contractors,
cost over-runs, schedule delays, inadequate performance, and user resistance to
adoption.
The
legislature also finds that to ensure that investment in these projects leads to
the realization of essential outcomes and supports departments and agencies in a
nimble and flexible manner, additional specialized staff should be dedicated to
the success of IT modernization programs.
Accordingly,
the purpose of this Act is to establish an information technology modernization
program management office to provide guidance and support to major public information
technology projects.
SECTION 2. Chapter 27, Hawaii Revised Statutes, is amended by adding a new section to part VII to be appropriately designated and to read as follows:
"§27- Information
technology modernization program management
office. (a) There
is established an information technology modernization program management office
within the office of enterprise technology services. The information technology modernization program
management office shall work collaboratively with and provide guidance and support
to the major information technology projects of state executive departments and
agencies and the University of Hawaii system.
(b) The
chief information officer shall ensure that
the information technology modernization
program management office has the ability to act as a central resource and guide
each major project in implementing best practices for successful design,
development, and implementation of IT projects, including leadership and
business engagement, staffing, technology selection, business process
reengineering, procurement and contractor selection, security, data governance,
organizational change management, risk management, quality assurance, testing,
documentation, transition to operations, and other areas, as appropriate.
(c)
The sponsoring department or agency of a
major information technology project shall retain overall responsibility for
the success of the project and shall remain responsible for providing departmental
or agency leadership and business and user commitment and engagement. The department or agency and chief information
officer shall work cooperatively to develop a charter for the project that includes
a staffing assessment and responsibility matrix for each party to provide adequate
project staffing and capability to manage and support the project to successful
completion.
(d)
The department or agency and the chief
information officer shall monitor the cost, schedule, and performance parameters
of each major information technology project and track baseline changes to each
major information technology project.
(e)
For the purposes of this section, "major
information technology project" means a project that:
(1) Is subject to independent
verification and validation under section 27-43.6;
(2) Has total
expenditures over $1,000,000 or will take more than one year to implement; or
(3) Is critical to key business capability of one or more departments or agencies of the State.
The chief information officer may designate a project as a major
information technology project at the request of a department or agency."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2021.
