A BILL FOR AN ACT
RELATING TO FIBER OPTICS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§46- Fiber optic cable system; condominium. (a) On or after January 1, 2015, no building permit shall be issued for a new condominium, with ten or more units, subject to chapter 514B or a new planned community subject to chapter 421J that does not include a fiber optic cable system that meets the standards established pursuant to subsection (c).
(b) Nothing in this section shall preclude any county from establishing procedures and standards required to implement this section.
(c) The director of commerce and consumer affairs shall adopt rules pursuant to chapter 91 governing standards for fiber optic cable systems, including specifications for performance, materials, components, quality, and installation, no later than December 31, 2014."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect on July 1, 2112.
