A BILL FOR AN ACT

 

 

RELATING TO FIBER OPTICS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 440J, Hawaii Revised Statutes, is amended by amending the title to read as follows:

"[[]CHAPTER 440J[]]

TELECOMMUNICATIONS AND CABLE INDUSTRY [INFORMATION REPORTING]"

     SECTION 2.  Chapter 440J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§440J-    Broadband wireline infrastructure required for new condominium and planned community construction.  (a)  On or after January 1, 2014, no building permit shall be issued for a new condominium subject to chapter 514B or a new planned community that does not include infrastructure that will accommodate, at a minimum, fiber optic cable to be used to provide broadband telecommunication services, including, but not limited to, available conduit capacity and a dedicated junction box for each housing unit or building.

     (b)  Nothing in this section shall preclude any county from establishing procedures and standards required to implement this section."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on January 1, 2018.

Description:

Requires installation of infrastructure that accommodates, at a minimum, fiber optic cable broadband systems in new condominiums and planned communities.  Effective January 1, 2018.  (SB1236 HD1)
