A BILL FOR AN ACT

 

 

RELATING TO THE MARIJUANA EVALUATION TASK FORCE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that Act 273, Session Laws of Hawaii 2019 (Act 273), created a marijuana evaluation task force whose purpose was to "examine other states' laws, penalties, and outcomes pertaining to marijuana use, other than marijuana use for medical purposes, and make recommendations on amending marijuana use penalties and outcomes in the State".  The legislature also finds that Act 273 required the marijuana evaluation task force to submit a report of its findings and recommendations to the legislature twenty days before the convening of the 2021 regular session.  The marijuana evaluation task force is scheduled to dissolve on June 30, 2021.  Because of disruptions caused by the coronavirus disease 2019 pandemic, the marijuana evaluation task force was unable to complete its task by twenty days before the convening of the 2021 regular session and will not complete its report prior to its scheduled dissolution date.

     The purpose of this Act is to amend Act 273 to:

     (1)  Extend the time the marijuana evaluation task force has to submit its report to the legislature to twenty days before the convening of the 2022 regular session;

     (2)  Extend the dissolution date of the marijuana evaluation task force to June 30, 2022; and

     (3)  Require the marijuana evaluation task force to also examine any economic benefits that may result from amending marijuana use penalties and outcomes in the State.

     SECTION 2.  Act 273, Session Laws of Hawaii 2019, section 4, is amended as follows:

     1.  By amending subsection (a) to read:

     "(a)  There shall be established a marijuana evaluation task force to be administratively attached to the department of the attorney general.  The marijuana evaluation task force shall examine other states' laws, penalties, economic benefits, and outcomes pertaining to marijuana use, other than marijuana use for medical purposes, and make recommendations on amending marijuana use penalties and outcomes in the State."

     2.  By amending subsections (d) and (e) to read:

     "(d)  The marijuana evaluation task force shall submit a report of its findings and recommendations, including any proposed legislation, no later than twenty days before the convening of the [2021] 2022 regular session.

     (e)  The marijuana evaluation task force shall be dissolved on June 30, [2021.] 2022."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
