HOUSE CONCURRENT

RESOLUTION

 

 

requesting the department of budget and finance to provide a status REPORT on the hawaii able savings program.

 

 

 


     WHEREAS, Act 206, Session Laws of Hawaii 2015, provided the authority for the Director of Finance to establish the Hawaii ABLE Savings Program (Program), a qualified tax exempt savings program; and

 

     WHEREAS, the intent of establishing the Program was to enable the State to remain in conformance with the Stephen Beck, Jr., Achieving a Better Life Experience Act of 2014, Division B of Public Law 113-295, by encouraging and assisting individuals and families to save private funds to support individuals with disabilities; and

 

     WHEREAS, the Program would assist individuals with disabilities in maintaining health, independence, and quality of life; and

 

     WHEREAS, there are eligible Hawaii residents who would benefit from the Program; and

 

WHEREAS, although section 256B-3(a), Hawaii Revised Statutes, requires the Director of Finance to conduct an annual evaluation of the Program and prepare an annual report of the evaluation to be submitted to the Governor and the Legislature, the Director has not submitted any evaluation or report to the Legislature; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2017, the Senate concurring, that the Department of Budget and Finance is requested to provide a status report on the establishment and implementation of the Hawaii ABLE Savings Program to the Legislature; and

 

     BE IT FURTHER RESOLVED that the Department of Budget and Finance submit this status report to the Legislature no later than 20 days before the convening of the Regular Session of 2018; and

 

     BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Director of Finance.
