HOUSE CONCURRENT

RESOLUTION

 

 

requesting the department of transportation to convene a working group to evaluate the regulation of personal vehicle rentals and to consider standards of practice for this industry.

 

 

 


     WHEREAS, public modes of transportation have transformed in recent years, moving away from traditional taxi services and now allowing for private individuals to use their personal vehicles for transportation services that were traditionally occupied by taxis through transportation network companies; and

 

     WHEREAS, a new mode of transportation has recently developed where private individuals are now renting their personal vehicles to other individuals as a commercial enterprise via third party web-based platforms; and

 

     WHEREAS, in the State of Hawaii, there are anywhere up to 150 personal vehicles available to rent via third party web-based platforms ranging from $30 to $550 per day; and

 

     WHEREAS, in many cases, these personal vehicles are being rented to out-of-state visitors via the airport without any regulation, resulting in a loss of revenue to the State; and

 

     WHEREAS, renting personal vehicles on a fee basis via third party web-based platforms is currently unregulated and as a result, there are no regulations in place to ensure that vehicle safety standards are met, that vehicles are being rented to qualified individuals, and that the vehicles have adequate insurance coverage; now, therefore,

     BE IT RESOLVED by the House of Representatives of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2018, the Senate concurring, that the Department of Transportation is requested to convene a working group to evaluate the regulation of personal vehicle rentals and to consider standards of practice for this emerging industry to ensure the safety of the public; and

 

     BE IT FURTHER RESOLVED that the Director of Transportation is requested to serve as the Chair of the working group and to invite participation by one representative from each of the following:

 

     (1)  The Department of Transportation;

 

     (2)  The Department of Commerce and Consumer Affairs Insurance Commissioner or the Insurance Commissioner's designee;

 

     (3)  The Department of Commerce and Consumer Affairs Consumer Advocate or the Consumer Advocate's designee;

 

     (4)  Two motor vehicle rental companies with a presence in the State of Hawaii; and

 

     (5)  Two licensed automobile insurers conducting business in the State of Hawaii; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Transportation and the Director of Commerce and Consumer Affairs.
