HOUSE CONCURRENT
RESOLUTION
AUTHORIZING THE ISSUANCE OF A LEASE COVERING STATE SUBMERGED LANDS AT PIER 27 IN HONOLULU HARBOR, OAHU, TO ATLANTIS SUBMARINES HAWAII, LLC.
WHEREAS, as part of the Honolulu Harbor Master Plan for the Kapalama Container Terminal, the State is developing a new overseas container terminal in Honolulu Harbor, Oahu; and
WHEREAS, as set forth in the August 2014 Kapalama Container Terminal and Tenant Relocations Final Environmental Impact Statement, Atlantis Submarines Hawaii, LLC, operates a repair and maintenance facility in Honolulu Harbor and has been relocated by the State from Pier 41 to Pier 27; and
WHEREAS, the Department of Transportation, with the prior approval of the Board of Land and Natural Resources, will enter into a lease with Atlantis Submarines Hawaii, LLC, that will include the fast lands at Pier 27, Honolulu Harbor, Oahu, tax map key: (1) 1-5-038:78 (portion) and include state submerged lands fronting the property bound by Pier 27, identified as tax map key: (1) 1-5-038:78 (portion), which together comprise an area of approximately 26,876 square feet; and
WHEREAS, section 171-53(c), Hawaii Revised Statutes, requires approval of the Governor and authorization of the Legislature by concurrent resolution for the leasing of state submerged lands; now, therefore,
BE IT RESOLVED by the House of Representatives of the Thirty-first Legislature of the State of Hawaii, Regular Session of 2021, the Senate concurring, that the Department of Transportation, with the prior approval of the Board of Land and Natural Resources, is hereby authorized to issue a lease to Atlantis Submarines Hawaii, LLC, for the state submerged lands fronting the property bound by Pier 27, identified as tax map key: (1) 1-5-038:78 (portion), which together comprise an area of approximately 26,876 square feet; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Transportation and Chairperson of the Board of Land and Natural Resources.
