A BILL FOR AN ACT


 

 

RELATING TO VETERANS SCHOLARSHIP PROGRAM.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 304A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§304A-    Veterans scholarship program.  (a)  There is established a veterans scholarship program to be placed administratively within the University of Hawaii.

     (b)  The University of Hawaii shall provide scholarships to eligible applicants who are residents of the State upon confirmation from an approved educational institution that the applicant has been accepted for enrollment in an approved course of study.  Scholarships shall apply only to tuition, books, laboratory fees, and other required educational fees.

     (c)  The University of Hawaii shall identify by rule the approved courses of study, approved educational institutions (including vocational schools), and qualifying fees and costs that are subject to this section.

     (d)  To receive a scholarship under this chapter, an applicant shall:

     (1)  Maintain a domicile in Hawaii during the term of the scholarship;

     (2)  Comply with any requirements or conditions placed on the scholarship by the University of Hawaii;

     (3)  Maintain a grade point average of 2.0 or higher, on a scale of 4.0 or its equivalent; and

     (4)  Enter into a written agreement with the University of Hawaii to:

         (A)  Satisfy all degree and other requirements under this program; and

         (B)  Reimburse the State for all amounts received under this program and interest thereon, as determined by the University of Hawaii, if the applicant fails to comply with this section.

     (e)  In addition to the requirements of subsection (d), an applicant shall have also served as:

     (1)  A nurse or honorably discharged member of the armed forces of the United States who served during World War I;

     (2)  A nurse or member of the Women's Army Auxiliary Corps, member of the Women's Auxiliary Volunteer Emergency Service, or an honorably discharged member of the armed forces of the United States who served during World War II;

     (3)  An honorably discharged member of the armed forces of the United States who served during the Korean war; or

     (4)  An honorably discharged member of the armed forces of the United States who served on active military duty, excluding training, for more than one hundred eighty days and who served a portion of their active duty during:

         (A)  The cold war which began on June 27, 1950, until the end of the Korean war;

         (B)  The Vietnam era which began on December 21, 1961, and ended on May 7, 1975;

         (C)  The Grenada and Lebanon era which began on August 24, 1982, and ended on July 31, 1984;

         (D)  The Panama era which began on December 20, 1989, and ended on January 21, 1990;

         (E)  The Persian Gulf war which began on August 2, 1990, and ended on September 1, 1997;

         (F)  The national emergency by reason of certain terrorist attacks that began on September 11, 2001; or

         (G)  Any other national emergency that involves the United Stated armed forces that is declared in accordance with federal law.

     (f)  The scholarship shall also apply and inure to the benefit of:

     (1)  The immediate children of members of the armed forces of the United States; provided that the members:

         (A)  Were killed while serving on active duty or died while in service; provided that the deaths are documented and directly caused by illness or injury connected with service in the United States armed forces;

         (B)  Are missing in action; or

         (C)  Became totally disabled for purposes of employability according to the disability ratings of the Department of Veterans Affairs as a result of a service-related injury; and

     (2)  Orphans or children of members of the Hawaii national guard and Hawaii reserve; provided that the members:

         (A)  Were killed after January 1, 1946, while on active duty either in the service of the State or the United States; or

         (B)  Are totally disabled for purposes of employability according to the disability ratings of the United States Department of Veterans Affairs, regardless of whether the members are eligible to receive disability benefits from the department as a result of a service-related injury suffered after January 1, 1946, while on active duty either in the service of the State or the United States.

     (g)  The scholarship is only transferable to another approved educational institution and is limited to funds appropriated for the purposes of this section.

     (h)  An applicant shall not receive benefits under this section for more than a cumulative total of one hundred fifty credit hours.

     (i)  The scholarship shall not apply to an applicant that receives educational benefits under federal law if the value of those benefits is equal to or exceeds the scholarship.  If the value of the federal benefits does not equal or exceed the value of the scholarship, the applicant shall first utilize the federal benefit such that the combined amount of the federal benefit plus the amount of the scholarship shall not exceed the maximum value of the scholarship.

     (j)  An applicant is not eligible for a scholarship if the applicant is in default on any:

     (1)  Loan made or guaranteed for educational purposes by the State; or

     (2)  Other debt owed to the University of Hawaii or any approved educational institution.

     (k)  The University of Hawaii shall adopt rules pursuant to chapter 91 to effectuate this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
